On April 28th, 2026, I was dispatched to 80 Main St., Market Place (AT&T) in reference to a disorderly male.

Upon arrival, I made contact with Complainant who stated that a male, later identified as Mr. Mark Sizemore, drove into the parking lot and improperly parked his vehicle in a handicap parking space before entering the business. Complainant advised that when Sizemore entered the AT&T store, he had multiple electronic devices and claimed that someone had placed viruses on them. He requested six new, high-end replacement items.

Complainant further stated that when employees were unable to locate Sizemore in their system, he became irate. Sizemore then threw his items into a nearby recycling bin, exited the store, and urinated on the exterior of the building.

I then made contact with Mr. Sizemore and asked what had occurred. Sizemore stated that he was attempting to obtain new electronic devices because he believed his current devices had viruses. While speaking with Sizemore, I observed that his pupils were dilated and did not adjust when transitioning between darker and lighter areas. Based on my training and experience, this is consistent with individuals under the influence of narcotics.

Sizemore also spoke in a low tone with run-on, incoherent sentences and repeatedly stated that his mouth was extremely dry, which is another indicator of possible narcotic impairment.

I asked Sizemore how he arrived at the location, and he stated that he drove his vehicle. He pointed to a blue Toyota Tacoma bearing Georgia tag, which was parked in a handicap space and occupying multiple spaces.

I then asked Sizemore if he had consumed any alcohol or taken any narcotics. Sizemore stated that he does not drink alcohol but admitted to taking two half Xanax bars prior to driving to the location.

I asked Sizemore if he would be willing to perform standardized field sobriety evaluations to ensure he was safe to drive, and he agreed. Prior to beginning, I asked if he had any traumatic brain injuries or was under a doctor’s care. Sizemore stated that he did, but his statements were incoherent and did not provide clear information. I also asked if he was able to stand on one leg, and walk in a straight he stated that he could.

I began explaining the Walk and Turn evaluation and instructed Sizemore to assume the starting position. Sizemore attempted to mimic my movements but then stated he was unable to perform the evaluation due to the position.

I then attempted to administer the One Leg Stand evaluation. Sizemore was instructed multiple times to maintain the starting position but failed to comply, lifting his legs repeatedly and eventually grabbing his truck for support while counting aloud.

Due to concerns for his safety, I discontinued the field sobriety evaluations. Based on my observations and his admission to consuming Xanax prior to driving, I placed Sizemore under arrest for DUI (Drugs). He was placed in handcuffs behind his back, checked for proper fit, and double locked.

A search incident to arrest was conducted, and no contraband was found. Sizemore was placed in the rear of my patrol vehicle, which had been searched prior to and at the beginning of my shift, with no contraband present.

Sizemore’s vehicle was removed from the property by Wilson’s towing.

I then read the Georgia Implied Consent Notice for suspects age 21 and over, requesting a state-administered blood test. Sizemore agreed, and the consent was time-stamped by Bartow County 911.

Sizemore was transported to the Cartersville Police Department, where a search warrant for his blood was obtained. He was then transported to Cartersville Medical Center, where a blood sample was collected and sealed in a blood test kit.

Sizemore was subsequently transported to the Bartow County Sheriff’s Office without incident, where a warrant was obtained for DUI (Drugs).

The blood test kit was submitted into evidence, and a GBI submission form was completed.
