On Tuesday, September 1, 2026, at approximately 1708 hours, I was dispatched to GA 3 at the intersection of Martin Luther King Jr Dr for an unknown problem. Upon my arrival, I noticed a vehicle (silver 2010 Chevrolet Malibu bearing tag# [REDACTED]) at the traffic light with the driver who appeared to be passed out. I identified the driver as Mr. Nathaniel Gravley. Mr. Gravley was in the driver’s seat with the engine running and the vehicle in drive.

Mr. Gravley stated he was arguing with his mother the night before. Mr. Gravley informed me he left his residence at approximately 0400 hours and had to be at work at 0600 hours and was real sleepy. As I was speaking to Mr. Gravley, I noticed an open alcoholic beverage in the center console of the vehicle. I noticed an odor of an alcoholic beverage coming from Mr. Gravley. I instructed Mr. Gravley to exit the vehicle. When I asked Mr. Gravley about the open container, he stated he had been drinking on his way to his residence. I ask Mr. Gravley if he would agree to field sobriety testing and he agreed.

Horizontal Gaze Nystagmus (HGN)

During HGN I noticed Mr. Gravley’s eyes had equal tracking and equal pupil size. I noticed lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, and onset of nystagmus prior to 45 degrees in both eyes. I noticed a total of six clues.

Walk and Turn

I noticed one clue during the walk and turn. Mr. Gravley missed heal to toe once.

One Leg Stand

I noticed one clue during the one leg stand. Mr. Gravley put his foot down once.

Preliminary Breath Test (PBT)

Mr. Gravley agreed to blow into a PBT with a result of 0.107.

I placed Mr. Gravley into handcuffs behind the back, checked for fit, and double locked for safety. A search of Mr. Gravley was conducted yielding negative of weapons and contraband. I placed Mr. Gravley into the back of my marked patrol vehicle which is searched before and after transport yielding negative of contraband. I transported Mr. Gravley to 195 Cassville Rd (Cartersville Public Safety Headquarters) to obtain a search warrant (26-SW-000269, EDocket # E003688).

I transported Mr. Gravley to 960 Joe Frank Harris Pkwy (Piedmont Cartersville Medical Center) for a GBI blood draw. Nurse [REDACTED] preformed the blood draw of Mr. Gravley. I transported Mr. Gravley to 104 Zena Dr (Bartow County Jail) for housing. I obtained warrants for (CE-0183197) DUI, (CE-0183198) open container, and a return search warrant. Mr. Gravley’s vehicle was released to Mr. [REDACTED]. GBI Blood Kit was entered into evidence in refrigerator 1 and the key was placed into locker number 24.
