On 08/21/2026 I, Officer D. Blackmon while employed with the Adairsville Police Department Uniformed Patrol Division, was observing traffic in the area of Adairsville Pleasant Valley and Manning Mill Road. While in the area I noticed a black in color Nissan Titan pass by that appeared to have very dark windows. At this time I began to follow the Nissan Titan on Adairsville Pleasant towards Patterson Lane. As we traveled on Adairsville Pleasant Valley I observed the truck cross over the white shoulder line on multiple occasions leaving the road. At this time I initiated my emergency equipment to conduct a traffic stop.
The vehicle then came to a stop on Patterson Lane. I then approached the vehicle, and made contact with the driver Terry Hicks. While speaking with Mr. Hicks I noticed that his eyes were red and glossy, and his speech was slurred. I could also smell the odor of an alcoholic beverage coming from his person. I also noticed that Mr. Hicks was very nervous. His hands were shaking, his breathing was very rapid, and he had a hard time completing words. I asked Mr. Hicks if he had been drinking that day, and he stated no. Mr. Hicks was also sweating profusely. At this time I asked Mr. Hicks to exit the vehicle.
As Mr. Hicks exited the vehicle I asked if he had any weapons, or anything illegal on his person and he stated he had a knife in his pocket. I then asked Mr. Hicks for consent to search his person which he gave consent. I then conducted a search of Mr. Hicks with no findings. I then asked Mr. Hicks if he had anything illegal in his vehicle, and he stated no. I then asked Mr. Hicks for consent to search his vehicle which he denied. I then noticed a empty alcoholic beverage can in the bed of Mr. Hicks truck, and he stated someone he worked with had drank that earlier. I then asked Mr. Hicks again if he had been drinking, and advised him that I could smell alcohol coming from his person. Mr. Hicks then agreed that he had been drinking that day, and then agreed to submit to a portable breath test. I then gave Mr. Hicks the breath test which he refused to blow into.
At this time I asked Mr. Hicks if he would submit to Standardized Field Sobriety Testing, and he stated that he would. I then gave Mr. Hicks instructions for Horizontal Gaze Nystagmus(HGN), and asked if he understood the instructions. He stated he did, and at this time I conducted the test. During the test I observed lack of smooth pursuit in both eyes, Distinct and Sustained Nystagmus in both eyes at maximum deviation, and onset of nystagmus prior to 45 degrees. Mr. Hicks displayed all six possible clues from this test. Also during the test Mr. Hicks was leaning forward trying to hold his balance. I then instructed Mr. Hicks on the Walk and Turn. Mr. Hicks stated he understood the instructions, and at this time I conducted the Walk and Turn test.
During the instruction phase Mr. Hicks lost his balance, and failed to stand properly after being instructed. Mr. Hicks also started too soon, and missed heel to toe steps going down. Mr. Hicks also used his arms for balance, and made an improper turn. Mr. Hicks displayed five clues out of the possible eight for this test. I then instructed Mr. Hicks on the One Leg Stand Test. Mr. Hicks stated he understood the instructions, and at that I conducted the test. During the test Mr. Hicks put his feet down on multiple occasions, and actually swapped feet during the test. Mr. Hicks also used his arms to balance, and swayed displaying three of the possible four clues for this test.
After completing the tests I spoke with Mr. Hicks again who stated that he had a couple wine coolers today while he was working. Mr. Hicks then stated he probably drank between two and three Cayman Jack Margaritas. After speaking with Mr. Hicks it was determined that he was under the influence of alcohol, and I advised him he was under arrest. I then read Mr. Hicks implied consent for persons 21yoa and over, which he refused testing of his blood. Mr. Hicks was then placed into the back of my patrol vehicle.
I then conducted a search of the Mr. Hicks vehicle incident to arrest. During the search of the vehicle I located a clear plastic bag, containing a white crystal substance believed to be Methamphetamine, inside of pillow that Mr. Hicks had been sitting on in the driver’s seat. The white crystal substance weighed approximately 15.1 grams. After completing the search and inventory the Next List towing company, Stacey’s Towing, was contacted, and removed the vehicle from the scene.
I then read Mr. Hicks his Miranda Warning, and he waived his Rights at that time. Mr. Hicks stated that the Methamphetamine belonged to him, and that it was for personal use. After speaking with Mr. Hicks I transported him to the Bartow County Jail without incident. All evidence was collected, photographed, and turned into evidence locker #006 at the Adairsville Police Department.
