On November 29th, 2025 at approximately 1915 hours, I responded to [6000 BLOCK] N Main St. in reference to a trespassing.
Upon arrival, I spoke with Mr. Tommy Nichols. He advised me that his wife’s friend, Ms. [REDACTED] was at the residence and he wanted her criminally trespassed from the residence. While speaking with Mr. Nichols I could smell a strong odor of an alcoholic beverage emitting from his person. I spoke with his wife, Ms. [VICTIM #1] who advised me that Ms. [REDACTED] was welcome at the residence and that she takes care of her while she is having health problems. After advising Mr. Nichols that Ms. [REDACTED] had a legal right to be at the residence, he became irate. A short while after I left the scene, Mr. Nichols called Bartow County Dispatch again requesting to speak with a deputy regarding the trespassing incident. I spoke with him via telephone and advised him again that Ms. [REDACTED] was legally allowed to be at the residence and also explained the criminal trespass law.
At approximately 21:15 hours, I was dispatched to Mr. Nichols residence again for a trespassing complaint. Bartow County 911 advised me that Mr. Nichols called them a total of 9 times regarding a trespassing since I left on the first call.
Upon arrival, Mr. Nichols advised me that he wanted Ms. [REDACTED] to be criminally trespassed from his property. After explaining the trespassing law again, he was placed in handcuffs with his hands behind his back. The handcuffs were checked for proper fitment and double locked to ensure no further tightening.
Ms. [VICTIM #1] advised me that the day before on 11/28/2025 after asking if she could use his truck to get groceries, Mr. Nichols became irate, grabbed a baseball bat and walked up to Ms. [VICTIM #1] holding it up against his shoulder then pointed it at her. Ms. [VICTIM #1] stated that she smiled at him and told him to go ahead and hit her and he would be going to prison. Mr. Nichols then put the bat down. Ms. [VICTIM #1] stated that Mr. Nichols was heavily intoxicated during the incident and that she was never in fear for receiving injuries because she knew he wouldn’t hit her.
After reading Mr. Nichols Miranda Rights, Mr. Nichols advised me that Ms. [VICTIM #1] asked him to use his truck but no argument took place.
Mr. Nichols was transported without incident to the Bartow County Sheriff’s Office where a warrant has been issued for Unlawful conduct during 911 calls.
Due to Ms. [VICTIM #1] stating that she was not in fear for receiving injuries as well as knowing Mr. Nichols was not going to hit her, the charge for simple assault was unfounded due to insufficient probable cause.
