On Wednesday, March 8, 2023 at 1917, I was dispatched to [SINGLE DIGIT BLOCK] Wayside RD. SE Cartersville GA, 30120 in reference to a fight.
Upon arriving on scene, I spoke with [WITNESS #1] (Complainant), who said that her two (2) sons [REDACTED BY AGENCY] suspect) and Tyler (suspect) had been a physical altercation. She said that her and [WITNESS #2] had to physically separate the two boys. She said that she took [REDACTED BY AGENCY] to another room for about 5-10 mins for him to calm down.
[WITNESS #1] said that once [REDACTED BY AGENCY] Was calm down enough she went to the living room and told Tyler that this had to stop. She said that [REDACTED BY AGENCY] came out of the room and went and got a knife from the kitchen and stood in front of Tyler while hold it. She said that Tyler retrieved a skate since [REDACTED BY AGENCY] had gone a got a knife. [WITNESS #1] said that she wrestled the knife away from [REDACTED BY AGENCY] and he went and retrieved another knife. [WITNESS #1] said when [REDACTED BY AGENCY] got the second knife, she call the police.
After speaking with [WITNESS #1], I spoke with Tyler Smith (suspect), who said that him and his little brother [REDACTED BY AGENCY] had got into a physical altercation after [REDACTED BY AGENCY] called him out for wearing his socks. Tyler admitted that he did shove [REDACTED BY AGENCY] to start the altercation. Tyler said that his mom and aunt had to break them up and his mother took [REDACTED BY AGENCY] into another room. Tyler said that after a few mins [REDACTED BY AGENCY] came out of the room and went to the kitchen and got a knife and came and stood in front of him. He also said, he was in fear of what his brother would do so he grabbed a skateboard to defend himself.
After speaking with Tyler, I spoke with [REDACTED BY AGENCY] (suspect), who confirmed that his mother had taken him into a separate room for him to calm down from the initial confrontation with his for about 5-10 mins. He said when he calmed down a little, he heard his brother say something and he decided to come out and get a knifes cause his brother, Tyler had picked up the skateboard and held it like he was going to hit him with it which put him in fear. [REDACTED BY AGENCY] also confirmed that Tyler had shoved him to start the altercation.
I spoke with [WITNESS #2] (Complainant), who confirmed the account that [WITNESS #1] gave. At this time, Tyler Smith was placed under arrest for Battery against his little brother due to leaving redness and marks on his chest and back area and also leaving two (2) noticeable lumps on [REDACTED BY AGENCY] forehead. Tyler was transported to the Bartow County Detention Center by Cpl. Fleming #938 without incident.
After Tyler was removed from the scene, I called and spoke with [REDACTED] of the Dept. of Juvenile Justice and informed her that I would be arresting [REDACTED BY AGENCY] on the charge of Agg. Assault due to the fact, he was away from the initial situation for a significant time period. I gave all the operant information she needed. She contacted me to let me know that the Dept. would not be detaining [REDACTED BY AGENCY] at this time.
I informed [WITNESS #1] of what was happening and that [REDACTED] would like to see her and [REDACTED BY AGENCY] in her office tomorrow morning. [WITNESS #1] said that she would be there.
