On May 11, 2023, at 1414 hours, I was dispatched to [4700 BLOCK] Highway 411 NE, Rydal, Georgia, in reference to an assault that had happened at this location while Deputy Caleb Black spoke with the victim at Piedmont Hospital in Cartersville.
Deputy Black stated that the victim, [VICTIM #1], said she was painting in her home when she heard someone banging on the door. She walked down the hallway to see who it was and observed a white male, identified as Wayne Garland, wearing a hat and bulletproof vest and holding a gun. [VICTIM #1] said that she thought it was the Police due to the shiny gold shield on the male’s chest that resembled a badge.
[VICTIM #1] also stated that the male leaned in through the open window at the front of the house and stated his name was Wayne Garland. She continued saying that he pointed the gun at her and asked her where [REDACTED] was and that he wanted his “sh*t” back. [VICTIM #1] told Wayne that [REDACTED] did not live at that residence. [VICTIM #1] stated that she observed [WITNESS #1] standing in her kitchen and that he entered the house through the open back door. [VICTIM #1] said that she ran outside the house and approached Wayne. She also advised that while she was walking up the steps, Wayne struck her in the head twice with a gun, causing her to bleed. She also said that she shielded her face when he struck her again in the arm. [VICTIM #1] stated that she was hurting badly and was dazed.
[VICTIM #1] stated to Wayne that she was calling the Police, and Wayne stated that he was the Police and that they were already on their way. [VICTIM #1] said that [WITNESS #1] told Wayne that they needed to leave. Both males then left and headed towards Fairmount in a black dodge ram pickup.
[VICTIM #1] said that she waited on the back porch until her friend, [REDACTED] arrived and transported her to the hospital.
Deputy Caleb said [VICTIM #1] had a broken left arm and multiple injuries to the face, that required staples with a concussion.
Upon my arrival at [4700 BLOCK] Highway 411, where the assault occurred, I walked to the front door of the residence, where I observed an open window to the right side of the door. I then walked around to the back side of the residence, where I observed a sliding glass door that was closed.
I relocated to [60 BLOCK] East Pleasant Valley Road, Rydal, Ga, and spoke with [WITNESS #1]. I asked [WITNESS #1] what happened at [4700 BLOCK] Highway 411, and he stated that he and Wayne went over to the house because Wayne believed there were items inside that were stolen from him. I also asked him about the assault, and he stated that [VICTIM #1] came at Wayne with a metal pipe, and [WAYNE] hit her with a black pipe.
Deputy Corbin Heaston spoke with [WITNESS #1] and asked him why Wayne hit [VICTIM #1] with a gun, and he stated that he did it because [VICTIM #1] went to Wayne with a pipe. Deputy Heaston said he stated to [WITNESS #1], “I’m surprised he didn’t shoot her,” and [WITNESS #1] said, “Me too.”
[WITNESS #1] was asked why he went into the residence, and he said he never went inside the residence.
After speaking with [WITNESS #1], I relocated to [10 BLOCK] Garland Road, Fairmount, Ga, and observed [WAYNE] run into the woods behind the residence. I relocated to [10 BLOCK] Garland Road and observed a green Ford F150 in the driveway of the residence. Upon approach of the vehicle, I observed a vest with two police-style badges in plain view in the passenger seat of the truck.
[REDACTED], the owner of [10 BLOCK] Garland Rd residence, pulled into the driveway behind me and said this f150 belonged to his cousin Wayne.
A search warrant was taken for the vest, and Wayne was unable to be located; I took warrants on Wayne Garland for Aggravated Assault, Aggravated Battery, receipt possession or transfer of a firearm by a convicted felon, possession of a firearm during the commission of or attempt to commit certain crimes, impersonating an officer, and criminal trespass.
