On 12/15/2022, at 2357 hours, I, Deputy T. Stephens, responded to [1700 BLOCK] Nussbaum Avenue in reference to an aggravated assault incident.

The suspect, Kymrick Banks, was upset with the mother of his children, victim, [VICTIM #1], for calling the authorities on him for a Family Violence incident that occurred earlier on 12-15-2022, at [1700 BLOCK] Nussbaum Avenue (Macon) 2022-109830.

On 12/15/2022, at 2357 hours, the suspect returned to the home with a Rifle, and fired several shots into the walls of the home and the floor. While inside of the home, the suspect also damaged several household appliances.

The suspect then walked outside where he parked his unknown get-a-way vehicle, and fired several more shots in the direction of the home, which caused more damage to both the exterior and interior of the home. That act also caused damage to a 2013 Chevrolet Suburban that was parked in front of [1700 BLOCK] Nussbaum Avenue. That vehicle had a bullet hole in the exterior body that caused fluid to leak onto the ground.

After the assault, the suspect drove away in an unknown direction. A total of 11 shell casings were retrieved and picked up off of the ground in the parking lot. Those shell casings were submitted into the BCSO Crime Lab as evidence.

During the incident, everyone locked themselves inside of the bathroom until BCSO Deputies arrived. The scene of the crime including witness statements and physical evidence was captured via my BCSO issued Body Camera. The suspect shares the townhome with Ms. [VICTIM #1] and ten other people (3 Adults/7 small children). Lt. Garrison was notified. Investigator Hall was notified.

Prior to my departure, several of the parties left the home but several other occupants elected to stay put. They were all given advice on how to contact the Crisis Line Safehouse for assistance.

Warrants will be sought on Mr. Banks for O.C.G.A. 16-5-21 Aggravated Assault, O.C.G.A. 16-5-70 Cruelty To Children, and O.C.G.A. 16-7-23 Criminal Damage To Property.
