On 10-01-2025 at about 2045 hours Cpl. Raines got a call for a hit and run crash. Once he was on scene the second driver said the driver of the truck that was all over the roadway and hit him had returned. The driver of the truck was a Hispanic male that had admitted having been drinking before the crash, that’s why I was called to the scene.
Once I was there, I contacted Cpl. Raines who told me that Wilfredo Vasquz-Rameriez was driving on Reynolds Dr all over the roadway, not maintaining his lane. Once he got close to the second vehicle, he went to pass the vehicle on the left and side swiped the vehicle. The truck then left the scene. He a few minutes later returned and the driver talked to the Hispanic Male. He went to leave again but ran off the roadway and he was about to keep him there until Cpl. Raines got there.
I went and talked to the Hispanic male, but he did not understand English very well. I asked if he had been drinking and he said “seven.” I did notice a very strong odor of alcoholic beverage coming from him. His eyes were bloodshot and glassy. I gave him the instruction for the HGN test, he did not stand with his hand by his side, but I attempted to do it anyways. I had to tell him and use hand signals for him to keep his head still; I did this but showed him with my hands to keep his head facing forward and only move his eyes to look at my finger. I did notice a lack of smooth pursuit in both eyes. He also had a distinct and sustained nystagmus at maximum deviation in both eyes. There was also an onset of nystagmus prior to 45 degrees. There was also a vertical nystagmus. I do believe that he understood how to do the test with me being about to complete it with him only moving his eyes and not his head. Because of the language barrier I did not do the other two standardized tests. There was no deputies that were Bi-lingual working and honestly did not think to call a translator line to assist.
I did get my PBT and on the fourth attempt I was able to get a sample enough to show a positive reading (.234). The first three attempts he would stop blowing before a proper sample could be collected, that’s the reason I did a “quick snap” on the fourth attempt.
He was arrested based on the clues I was able to observe during the HGN test as well has his admission to drinking seven. Also, the odor of alcoholic beverage on his breath and bloodshot, glassy eyes. Once in the rear of my patrol vehicle I read him Implied Consent Notice for Person over age of 21, from my green card dated 012323 asking for breath. He agreed and said he would give me a breath sample. The vehicle was towed by M&M Towing.
Once at the jail I did an Intoxilyzer 9000 test on him. The results were .227 and .224. He then did understand how to do the test and understood what I was asking him to do. There seemed to not be any issued with understanding me once we were at the jail. He also did not seem to have issues with understanding what the jail staff was asking of him when he needed to get phone numbers out of his phone. DPS 1205 form was also done.
