Officer’s Narrative:

On the stated date and time I was dispatched to the residence of [REDACTED BY AGENCY] Waynesville Brantley County GA in reference to an open line 911 call. On the way to the residence I was informed by dispatch that they could hear talking but would not communicate with the dispatcher. Dispatch informed me that a male stated that there was “Blood Everywhere”. As I was arriving at the residence Dispatched informed me that there was possibly a firearm involved.

I then walked up to the door and knocked, the door was opened by a [VICTIM #1]. I then asked [VICTIM #1] where the firearm was and he directed me to his brother’s room. I then went into the brother’s room to investigate what all was going on. When I went into the brother’s room (Michael Jack), I saw Michael sitting at a desk in the left corner of the room in a desk/swivel chair. I asked him where the firearm was located. Michael stated that he did not have a firearm at all.

After being able to see that Michael did not have a firearm, I then asked Michael what had occurred. I noticed that Michael’s nose was bleeding and Michael also had blood on his hands. Michael stated that he was in the kitchen cooking when [VICTIM #1] went into the kitchen and began to mess with him.

Michael stated that him and his brother do not get along. It was at this point that I could hear the slurring in Michael’s speech. I asked Michael if he had drank anything tonight and he stated that he did. Michael then kept saying to me “Look at him and look at me”. I asked Michael about the firearm and Michael stated “I don’t have a gun, you can check, I dont have one” as he was pointing around the bedroom. Michael stated that the only thing he had was a sling shot crossbow. It was at this time that Deputy Dasher and Sgt. Lee arrived on scene. I asked them if they could stay with Michael while I got [VICTIM #1]’s statement.

[VICTIM #1] stated that he went into the kitchen to make some coffee and walked around Michael. [VICTIM #1] stated that Michael became irate telling [VICTIM #1] to stop messing with him. [VICTIM #1] told Michael that all he was doing was making coffee. Michael still became argumentative and started bumping into [VICTIM #1] with his shoulder. [VICTIM #1] stated that he did push Michael to get him to stop bumping him. Michael eventually walked to his bedroom.

[VICTIM #1] stated that when Michael came back to the kitchen he was still arguing and during the arguing [VICTIM #1] looked down at Michael’s hand and Michael showed [VICTIM #1] that he was holding a handgun. [VICTIM #1] stated that the handgun was black in color with silver on the side. [VICTIM #1] stated that Michael had claimed to have gotten a .22 Magnum the day before from a neighbor. [VICTIM #1] then stated that him and his room mate had a video of the altercation.

The roommate [REDACTED] showed me the video that she had taken from the hallway in the home. In the video you can see Michael become irate with [VICTIM #1] and [VICTIM #1] telling Michael that he was just making coffee and to stop. As the arguing continues you can hear [VICTIM #1] say “Why are you going to pull a gun on me?”.

During the altercation [VICTIM #1] had also started recording on his phone and showed me the video. On the video you can hear Michael telling [VICTIM #1] to stop messing with him and [VICTIM #1] informs Michael that he is only getting coffee. The arguing continues until Michael walks away.

Mlcheal then returns to the kitchen and they begin to argue again. You can then hear [VICTIM #1] asking Michael why is he going to pull a gun out on him. Michael then walks off again. When Michael then comes back he asks [VICTIM #1] “if he wants some of this”. It was at this point that [VICTIM #1] informed me Michael was trying to wipe blood on him. [VICTIM #1] stated that he pushed him again to get him away from him.

EMS arrived on scene and SGT. Lee walked Michael outside to be checked out by EMS. Deputy Dasher Showed me that While he was in the bedroom with Michael he had found a Black air soft pistol on the floor. SGT. Lee, Deputy Dasher and myself went to Michaels room.

It was while we were in his room that SGT. Lee noticed through a bathroom door two Marijauna plants growing under a shelf with two grow lights. It was at this time that Sgt. Lee informed me to notifiy the on call investigator (Mike Foreman) to secure a search warrant. We were then notified that Michael was going to be transported to the hospital. We then exited Michael’s room and waited for the search warrant.

Once the warrant was signed by the magistrate judge the room was searched, the following is what was found.

Black in color air soft/BB pistol, Clear plastic bag with .22 bullets inside, Two plants tentatively identified as marijauna, two grow lights, and a seed planter.

As Investigator Foreman and myself were exiting Michael’s room after the search Michael returned from the hospital. Michael was then placed in custody for Aggravated assault and Manufacturing marijauna, he was then transported to the Brantley County jail.
