On 04/24/2026 at approximately 0309 hours, I, Deputy Montgomery, responded to the area of [100 BLOCK] Britton Road in reference to a Stranded Motorist complaint. Dispatch advised that the vehicle was in a ditch. While en route to the location, Dispatch advised the driver is potentially intoxicated, as the driver advised she was drinking at a friend’s house earlier in the night, and was going home before getting stuck in the ditch.

Upon my arrival, I met with Deputy Greene, who was speaking to the driver of the vehicle, later identified as Neariah Brinkley, which was located in a ditch off of the roadway. As I approached the black Toyota 4Runner (GA Tag [REDACTED]), I saw Brinkley located in the driver seat and the key to the vehicle in the ignition.

Upon making contact with Deputy Greene and Brinkley, I was able to observe her eyes to be bloodshot red. Also, her pupils were dilated, being larger than normal pupils would be. Deputy Greene asked her how much she had to drink tonight. Brinkley stated “not much, like 2 or 3 shots.” She then stated that she wasn’t driving, she just got in the car like two minutes ago.

She was then asked how the vehicle ended up in a ditch if she wasn’t driving, and her response was “two minutes ago.” When asked what she meant by “two minutes ago,” she stated “when you call dispatch, they have the record of that.” Due to her statements not making sense, I asked Brinkley to step out of the vehicle multiple times. Brinkley attempted to turn the vehicle on by twisting the key in the ignition multiple times before getting out of the vehicle. I then walked Brinkley over to the patrol vehicle.

While at the rear of the patrol vehicle, I asked Brinkley if she had her driver’s license on her. She then walked towards her vehicle stating that it was in the vehicle. I told Brinkley that the other Deputy would get it and to come back to the rear of the patrol vehicle. While speaking to her at the rear of the patrol vehicle, I was able to smell the odor of alcoholic beverage coming from her breath. Brinkley then stated that she didn’t want to talk.

I told Brinkley numerous times that she would not be going into the vehicle to get her license, and that she could tell the other Deputy where it was, which she refused. I then began asking her what her name was. After multiple times of asking these questions, she informed me that her name was “Riah Brinkley” and that her birthdate was [REDACTED]. Deputy Greene was then able to confirm her identity through dispatch, and that she was the registered owner of the vehicle. Brinkley had multiple mood changes, stemming from argumentative to normal speaking to crying during this conversation.

Deputy Greene asked Brinkley if she would participate in Field Sobriety Testing to make sure she was able to drive, in which she agreed to participate in. I then conducted the Field Sobriety Testing.

Horizontal Gaze Nystagmus (HGN)

Prior to attempting this test, Brinkley indicated she did not have any medical problems that would have prevented her from performing the test. Her eyes were checked and her pupils were equal sizes. Brinkley was instructed to follow the stimulus with her eyes only, keeping her head still. After stating the instructions, Brinkley attempted this test. No resting nystagmus was observed. I did have to pause and resume the testing due to Brinkley crying and not being able to fully keep her eyes open.

The results of this test displayed 6 of the 6 possible clues:

• A lack of smooth pursuit in the left eye
• A lack of smooth pursuit in the right eye
• A distinct and sustained nystagmus in the left eye at maximum deviation
• A distinct and sustained nystagmus in the right eye at maximum deviation
• An onset of nystagmus prior to 45 degrees in the left eye
• An onset of nystagmus prior to 45 degrees in the right eye

Walk and Turn

Prior to attempting this test, Brinkley indicated that she did not have any injuries that would prevent her from performing the test. Brinkley was instructed to put her left foot in front of her right foot, with her left heel touching her right toe. She was instructed to stand in this position with her hands to her side, prior to the rest of the instructions of the test being explained. Brinkley was instructed not to begin the test until told to start.

She was instructed to take nine steps forward starting from that position. After the ninth step she was to stop and turn around, taking a series of small steps with the other foot to turn around. After turning around, she was to take nine steps back in the direction she had come from. Brinkley was instructed not to stop once she began the test, and to count out loud. After the test was demonstrated, Brinkley was instructed to begin the test.

The results of this test displayed 1 of the 8 possible clues:

• She did not maintain the starting position during instruction

One Leg Stand

Prior to attempting this test, Brinkley indicated that she was involved in a car accident two days prior, but did not indicate that it would prevent her from performing the test. Brinkley was instructed to stand with her arms at her side during the test. She was instructed to raise the leg of her choice approximately 6 inches off the ground. While holding that position, she was to count out loud starting at one thousand one (one thousand one, one thousand two, one thousand three, …) and so forth until she reached 30. The test was demonstrated to [BRINKLEY]. After she indicated understanding the instructions, Brinkley attempted the test and raised her right leg.

The result of this test displayed 2 of the 4 possible clues:

• She used her right arm to balance by placing it on the patrol vehicle
• She put foot down while attempting test

She placed her foot down after counting to nine one thousand.

After the testing was completed, I instructed Brinkley to place her hands behind her back. She complied and was placed into handcuffs that were checked for fit and double locked. I read her Georgia Implied Consent Notice for Suspects Age 21 or Over off of my green DDS-354 card and asked her if she would submit to blood testing. Brinkley refused the testing of her blood.

Brinkley was then transported to the Butts County Jail where she was turned over to jail staff, along with a citation for Driving Under the Influence of Alcohol. Deputy Greene completed an Impound Sheet and her vehicle was turned over to CornerLot. A Department of Driver Services 1205 form was completed and submitted with Brinkley’s driver’s license.
