On 02/09/2026 at approximately 23:10 hours, I (Officer Mills) received a call about a domestic dispute occurring at [100 BLOCK] Robert Hendrix Drive. Upon arrival, I spoke to the suspect (Andrew Fleming)
Andrew was crying and moaning, and lying on his side outside the door. When trying to get Andrew to speak to me, he continued to cry and moan. Finally, Andrew sat up and spoke to me. I asked how much he had to drink, and he stated too much. I asked him what happened inside, and Andrew stated that nothing happened. I asked him if anything physical had happened inside, and he again stated that nothing had. I helped Andrew stand up and bring him to his aunt’s vehicle for stability and asked for consent to search him and his belongings. Andrew stated he didn’t care that I searched him. I physically searched Andrew and his belongings and told him to stand there with his hands on the vehicle so that he would not fall. Andrew started yelling at me, then at his uncle [REDACTED]
I then talked to the aunt [VICTIM #1], who stated that they had been to the bank earlier that day to deposit some money into [VICTIM #1]’s bank account, and he was perfectly fine. [VICTIM #1] stated that she had given Andrew ten dollars for going with her to the bank. Later in the day, Andrew helped another family member clean out their vehicle and received another ten dollars. Andrew had twenty dollars, went down to the store, and bought alcohol.
[VICTIM #1] stated that around 7 o’clock, Andrew returned home and was intoxicated and continuing to drink a Colt 45 until it was empty, becoming even more intoxicated. [VICTIM #1] stated that Andrew fell on the table in the living room, crushing everything and breaking the table. After falling, [VICTIM #1] stated that Andrew groped her, and when asked where, [VICTIM #1] stated that he grabbed her thigh and rubbed up her stomach on the outside of the clothing until she told Andrew to stop. [VICTIM #1] also stated that Andrew Stated “he wanted some pu*sy.” When [VICTIM #1] stated she was calling the cops, Andrew stated that he would blow up the house and that he would tell the officers that she helped him rob a bank.
When I went out and talked to Andrew, he was trying to enter the household and was placed under arrest. I told Andrew to sit up against the Aunt’s vehicle again. Andrew was being verbally combative and resisting. So I decided to go ahead and bring him to the protrol vehicle. Andrew decided he didn’t want to walk anymore and dropped to the ground. FTO Kennedy and I had to physically pick Andrew up and put him in the back of the patrol vehicle.
While having a conversation outside about his charges, Andrew started kicking his feet in the Vehicle and making crying and moaning sounds again. FTO kennedy and I decided we’d go ahead and take Andrew to Tanner Medical Center for a checkup. While on the way to Tanner, Andrew continued to cry and then started making threatening statements to FTO kennedy and me.
When we arrived at Tanner, Andrew got out of the vehicle and started screaming at the top of his lungs, making threatening statements about everyone. When we got Andrew into a room, he started being combative again and kicked me in the face. When trying to calm Andrew down, he started making more threatening statements toward the staff at Tanner and me. Once the Doctor found that he was okay, I then swung his legs out down toward the ground so he could be put back in the wheelchair. Andrew acted as if he had passed out and fell on the ground. Officer Darling caught his head so that it wouldn’t hit the ground. We put Andrew back on the medical bed, where the medical staff would perform sternum rubs. Andrew became aware, and we put him in the wheelchair so that we could take him to the Patrol vehicle.
While taking Andrew to the Carroll County Jail, Andrew continued to make threatening statements to FTO kennedy and me. I also read Andrew his Miranda rights and asked him if he understood what I read him; he stated that he did.
While trying to get Andrew out of the vehicle, Andrew started to show more combative behavior, stating, ” Don’t touch me, you’re not touching me. I went and got the Correctional Officers for assistance, and that’s when Andrew started to show resistance towards them. The correctional officers picked him up, and Andrew kicked the Correctional officer in the stomach. After getting Andrew into the cell, he started kicking and becoming even more combative. FTO kennedy and I assisted the Correctional Officers in getting Andrew into the cell.
Andrew was charged with Terroristic Threats, Obstruction, Simple Assault, Criminal Trespass, and Exploitation of Elderly Adult.
This falls under Family violence because Andrew has lived with [VICTIM #1] since 1999.
