Officer’s Narrative:

On 02/01/2026 at approximately 1813 hours, I (Ofc.Kennedy) responded to 690 Bankhead Highway (Burger King) regarding the following:
- A dispute between a female and Burger King staff members.
- The female was causing issues.
- The female was yelling and screaming.
- The female had black-and-cream hair.
Upon arrival, I located a female outside the restaurant speaking with Sgt. Brady Spruell. The female was identified as Breonna Daniel. Breonna had black-and-white hair, which matched the initial description.
I relocated inside the restaurant to speak with the staff regarding the incident. I spoke with the manager on shift, who was identified as [WITNESS #1]. I asked [WITNESS #1] what had happened before my arrival. [WITNESS #1] explained the following:
- Breonna entered the store before law enforcement arrived.
- Breonna came up to the front counter to order food.
- One of her staff members [VICTIM #1] walked up to assist her at the counter.
- Because the restaurant was busy, [VICTIM #1] informed her that she would have to wait.
- Breonna then became upset after being told to wait.
- Breonna began yelling and screaming at [VICTIM #1].
- Breonna was cursing and threatening [VICTIM #1].
- Breonna stated she would bring someone up there to handle him.
- She advised [VICTIM #1] to leave the back counter and go to the manager.
- She advised Breonna to leave the store, but she refused.
- Breonna would not leave the store until Law Enforcement arrived on the scene.
- Breonna was yelling and screaming in front of other customers.
It should be noted these are not direct quotes from [WITNESS #1], but rather generalized statements made to law enforcement at the time of the incident.
I relocated to speak with the staff member who was initially involved. The male was identified as [VICTIM #1]. I asked [VICTIM #1] what occurred prior to my arrival. [VICTIM #1] stated the following:
- Breonna was inside the store and at the front counter when he first made contact with her.
- Breonna started making comments about no one helping her right away when she came in.
- He did not help her right away because they were busy at that time.
- He informed Breonna that she needed to wait, and the staff would assist her shortly.
- When he told Breonna this, she became aggressive toward him.
- She began yelling at him and screaming.
- She began cursing at him and telling him that she would get someone to come beat him up.
- He began getting upset with her again after she kept making comments.
- His manager relocated him to the office, away from Breonna, following the argument.
It should be noted that these are not direct quotes but generalized statements made to law enforcement at the time of the incident.
While speaking with multiple staff members, two witnesses approached me and asked me to explain what occurred prior to my arrival. Both witnesses stated they were inside the restaurant during the incident. Both witnesses noted that they did not know Breonna or any staff members prior to the incident.
The first witness I spoke with was identified as [WITNESS #2]. [WITNESS #2] stated the following:
- Breonna began yelling at the staff.
- Breonna was cursing at the staff.
- Breonna kept saying she was going to get people to come up there to “handle” the staff.
- The male staff member did get aggressive with Breonna back.
- The male staff member initially walked away, but then returned after Breonna began saying she would get people to come handle him.
- They believed the male tried to retrain himself as best as possible before getting loud with Breonna.
- He would’ve acted similarly to the male staff member if he had been involved.
- He had his family with him at the time of the incident.
- The incident got so bad that he moved his family to another room to get away from it.
It should be noted that these are not direct quotes from [WITNESS #2], but rather generalized statements made to law enforcement at the time of the incident.
The second witness I spoke to was identified as [WITNESS #3]. [WITNESS #3] stated the following:
- Breonna was yelling loudly and screaming at the staff.
- Breonna repeatedly cursed at staff members.
- Breonna stated multiple times that she would get someone up there to deal with the staff members.
- Breonna was very aggressive.
- Breonna was attempting to eat with three juveniles.
- All three juveniles were present when the incident occurred.
- The juveniles agreed with her statements and stated they heard “bad words” come from Breonna.
It should be noted that these are not direct quotes from [WITNESS #3], but rather generalized statements made to law enforcement at the time of the incident.
I relocated to speak with Sgt. Spruell regarding the incident. Sgt. Spruell informed me that Breonna remained very aggressive toward him when he spoke with her about the incident. Breonna was upset because staff members told her and her mother to wait at the counter. Breonna was upset due to the way staff members were speaking to her. When asked if she stated “she would call people to come fight/handle staff members”, Breonna did not deny the allegations. Breonna was also accompanied by three juveniles during the time of the incident.
Due to staff members stating that she was cursing at them, multiple unbiased witnesses admitting to hearing Breonna curse at staff, multiple juveniles being present during which Breonna was cursing and threatening staff members, and determining Breonna was insinuating staff with multiple comments of getting bystanders up there to fight/harm staff members, she was arrested and charged with the following:
- Disorderly Conduct (Provoke/Engage/fight) – C66-7(A)(4)
- Diroderly Conduct (Obscene Language) – C66-7(A)(11)
Breonna was arrested, both hands to the rear. Handcuffs were double-locked and checked for proper fit. Breonna was relocated to my patrol vehicle and placed in the backseat for transport. Breonna was transported to Carroll County SO and turned over to staff for booking.
Breonna was issued a Criminal Trespass to the establishment (Burger King, 690 Bankhead Highway), per staff. Breonna understood and agreed not to return to the restaurant.
