On 11/18/2025 at approximately 2352 hours, I (Ofc. Kennedy) responded to Stewart Street for the following…
- Dispatch reported that a male was located at the gas station yelling loudly.
- Dispatch stated the male was yelling/barking at the dogs.
- The complainant noted that the male was wearing a black shirt.
- The suspect was walking towards the complainant’s house heading northbound.
Upon arrival, I located a black male walking northbound on the roadway. The male, later identified as Brian Keith, was wearing a black shirt and jacket. Brian appeared to be stumbling in the roadway. I positioned my marked patrol vehicle directly beside Brian and then exited to make contact. I initiated my blue lights prior to contact.
I walked up to Brian and asked him what he was doing. Brian explained the following…
- He had been drinking and was attempting to walk home.
- He left Paradise Apartments with his girlfriend.
- He had a dispute with his girlfriend while at the apartments.
- He was yelling at the dogs cause everyone had dogs.
It should be noted that these are not direct quotes made by Brian, but they are generalized statements made to law enforcement at the time of the incident.
While speaking to Brian, I noticed the following clues that led me to believe he was impaired at the time of the incident.
- Brian had the overwhelming odor of an alcoholic beverage coming from his person.
- Brian was slurring his speech while speaking to me.
- Brian’s eyes appeared to be glassy at the time of the incident.
- Brian was having trouble maintaining his balance during the investigation.
- Brian admitted to being “drunk.”
I obtained Brian’s information and returned to my vehicle to run his personal information. While inside my vehicle, I asked dispatch if Brian had any prior Criminal Trespass Notices from Paradise Apartments. It should be noted that Brian did state he was coming from Paradise at the beginning of the investigation.
Dispatch notifed me that Brian had an active Criminal Trespass from Paradise Apartments.
I briefly spoke with the complainant regarding the incident. The complaintant, later identified as [WITNESS #1], stated the following…
- She could hear loud noises coming from outside her residence.
- She began hearing her dogs bark while inside her residence.
- She exited her residence and observed a male in the parking lot of the gas station located directly beside her home.
- She observed the male yelling loudly.
- She became concerned for the male due to his behavior.
- She heard the male barking at her dogs from outside the residence.
It should be noted that these are not direct quotes made by [WITNESS #1], but they are generalized statements made to law enforcement at the time of the incident.
Due to observing multiple clues that Brian was under impaired at the time of the incident, Brian being in a public setting and cause a disturbance to residence/bystanders, Brian admitting that he was drunk at the time of the incident, and confirming that Brian had a prior Criminal Trespass Notice from Paradise Apartment ([1200 BLOCK] Stewart Street), he was arrested and charged with the following…
- Disorderly Conduct (Public Drunk) – C66-7(A)(21)
- Criminal Trespass (After Notice) – C66-11(B)(3)
Brian was handcuffed, both hands to the rear. The handcuffs were double-locked and checked for a proper fit. Brian was read Miranda Warnings. Brian continued to interrupt officers while attempting to read Miranda. Brian was relocated to the rear of my patrol vehicle and placed in the backseat for transport. Brian was seatbelted for safety. Brian was transported to the Carroll County Jail and turned over to staff for booking.
It should be noted that while at the Carroll County Jail, Brian did admit to being under the influence of “Ice”. Due to my past experience, I know “Ice” to be a slang term for methamphetamine. Nothing of interest was located during a search incident to arrest.
