On 03/14/2026, at approximately 0339 hours, I was dispatched to 202 Brumbelow Road (Kitty Mart) in reference to a verbal dispute in progress. Dispatch advised that the complainant, Cesar Tomas, stated that the store owner owes him money and attacked him psychologically.

I arrived on scene and observed Cesar standing outside. Cesar was in a shirt, a jacket, and black pants. Cesar’s pants were below his waistline, revealing the grey underwear he was wearing. Cesar’s eyes were red and glossy, and I could smell the odor of an alcoholic beverage coming from his person.

I began to interview Cesar, due to his mostly speaking spanish, I used a Google translator to speak to him. Cesar stated that his wife arrived at Kitty Mart and dropped him off. He was dropped off so he could play the games that are inside the store. Cesar was told to leave and said that he was told why and that he believes that the store clerk, [WITNESS #1], is racist.

Due to Cesar’s delayed response, lack of memory, slurred speech, glossy red eyes, swaying, and odor of alcoholic beverage coming from his breath, all indicate signs of someone under the influence of alcohol. I asked Cesar how many beers he had tonight, and he said four.

I interviewed a witness, [WITNESS #2], and asked her what happened tonight. [WITNESS #2] stated that Cesar was causing problems inside the store before she arrived. When she did arrive, [WITNESS #1] asked her to help make Cesar leave. [WITNESS #2] told Cesar that he had to leave the store and observed a can of beer in his hand. [WITNESS #2] witnessed Cesar begin to shake the can of beer everywhere, as he told her to call the police and refused to leave. [WITNESS #2] told Cesar that she was not going to call the police, and told him to call the police. Cesar then called the police.

Officer Dorsey spoke with [WITNESS #1]. Due to a language barrier between [WITNESS #1] and the officers, he gave a short statement to Officer Dorsey. [WITNESS #1] explained that he asked Cesar to leave and observed Cesar spilling beer on the floor and the counter. [WITNESS #1] provided photos and a video.

Upon further investigation, due to the observation I made of Cesar, Cesar admitted to drinking four beers and committing an indecent act by spilling alcohol around the store. I placed Cesar under arrest and applied handcuffs to his wrist. I placed Cesar into the back seat of my patrol car and transported him to Tanner Hospital. Tanner Hospital cleared him medically for release, and he was then transported to the Carroll County Jail, where the Jailers took custody of him.
