On 03/05/2026, at approximately 1755 hours, I was dispatched to 1124 North Park Street in reference to a dispute in progress. Dispatch advised that a male was yelling at an employee about taking his order, but he had already placed it. Dispatch advised that he appeared disoriented and fell asleep while leaning on a cooler.
I arrived and approached a male who was leaning against the counter. I approached Charmas Johnson and asked to see his identification card. He looked at me and asked why I was here. I explained to him that I am there because he has been yelling at employees. Charmas then looked at the complainant and cashier, [WITNESS #1], and stated, “Oh, you called them?”
While Charmas spoke to me, I noticed his eyes were watery and red, his speech was slurred, and I smelled alcohol on his breath. These are common signs of someone under the influence of alcohol. Charmas explained that he was waiting for his order, but could not tell me exactly what he ordered. He had to get [WITNESS #1] to tell him what he ordered.
I asked Charmas to sit down in a nearby chair and, once again, to provide his identification card. Charmas repeatedly said “No”. Charmas told me he has a Second Amendment right not to identify himself.
I asked Charmas how much he had been drinking, and he stated that he had nothing and that he was not going to answer that question. Charmas handed me his identification card and then dropped multiple other cards on the floor. I asked Charmas how much he had drunk again, and he said he was not answering that question. I explained to Charmas what I’ve observed about him. Charmas then asked me if I had his identification card.
I asked Charmas what he ordered again. Charmas then tried to get the attention of the cashier because he couldn’t remember what he ordered.
Charmas then handed [WITNESS #1] $2 to order a water bottle. While walking back from the fridge with a water bottle in his hand, Charmas put his hand on the counter to steady himself as he asked the cashier how long his food would take. As he opened his water bottle, he spilled water on the table and the ground.
Charmas was asked by officers to step outside. Charmas walked outside and proceeded to yell “Let’s just get it done!” as well as other things. Due to Charmas being loud and boisterous while still currently in a public place. Charmas was asked to keep it down. Charmas took a few steps back to lean against the wall in order to keep himself up. Charmas continued to yell at other points during our conversation.
Charmas stated that he arrived at Giovanni’s alone and identified his 2009 Mercedes-Benz (Ga Tag#: [REDACTED]) as his car. Charmas stated he did not drive, but arrived alone and had the car keys attached to his waistband. The car was parked with the driver’s side tires outside the lines marking the parking spot.
Charmas refused to take a field sobriety test. Charmas began yelling again and was told again to lower his voice.
Upon further investigation and discussing what was said to Ofc. Head by [WITNESS #1]. It was determined that Charmas was currently acting in a disorderly fashion in public while being drunk. Charmas created a public disturbance, was loud and boisterous, his eyes were red and watery, he could not stand up without leaning on something, he was slurring his words, couldn’t remember what he ordered because of intoxication, and the smell of an alcoholic beverage was emitting from his breath.
I placed Charmas under arrest and applied handcuffs to his wrist, double-locking them, and checked for fit. I then placed Charmas in the back of my patrol vehicle and escorted him to the Carroll County Jail, where the jailers took custody of him.
Charmas Johnson was charged with C66-7(A)(21) Dis. Conduct: Public Drunk.
