On April 23, 2026, at approximately 2218 hours, dispatch advised at Bankhead Highway lot 115, the complainant identified as [REDACTED] advised there was a truck stuck in his yard and he thinks the driver was impaired.

Upon my arrival, I observed a blue 2020 Ford F150 (MD TAG: xxxxxxxx the driver identified as Gerardo Pacheco -Lopez unconscious in the driver seat. I observed an overwhelming odor of alcoholic beverages emanating from within the cabin of the Ford. I observed Lopez to have bloodshot, watery, and glossy eyes. Gerrardo stated he did not have a driver’s license on him. Gerardo was unable to stand up on his own so he leaned back on the Ford. I asked Gerardo how many alcoholic beverages he consumed to which he advised four Modelo Beers. I attempted to conduct HGN on Gerardo however he could not even look at my stimulus.

Due to the strong odor of alcoholic beverages emanating from his person, his admittance to the consumption of alcoholic beverages, his driving manifestations, and his physical manifestations, I determined [GERARDO] to be under the influence of alcoholic beverages to the extent it was less safe for him to be operating his motor vehicle. I secured [GERARDO] to the front in double-locked handcuffs which were checked for proper fit. [GERARDO] was searched incident which yielded no contraband. [GERARDO] was seated in the rear of my vehicle without further incident. While seated in the rear of my vehicle, I confirmed with [GERARDO] she was 21 years old or over and read him the Georgia Implied Consent Notice for Suspects Age 21 and over (DDS-354, 05/2019) verbatim, requesting a state administered chemical test of his blood. Lopez remained silent. I took this as a refusal.

The Ford was towed by PBH Wrecker service. While conducting a inventory search, a open “Voodoo Ranger” alcoholic beverage was discovered with alcohol inside. There was also empty Four Loco alcoholic beverages inside the cabin of the Ford.

[REDACTED] stated Lopez was stuck on the tree stump for approximately thirty minutes.

Do to Lopez being severely intoxicated; there was a fear for his safety. Gerrardo was transported to Tanner Medical Center to be medically cleared. Lopez was then transported to the Carroll County Jail for book-in, processing, and housing. Gerardo was issued a ALS form. Both court copies and violator copies were placed in Gerardo’s box.
