Officer’s Narrative:

On 06/16/2021, at 01:06 hours, I, Ofc. Hicks, was conducting a foot patrol throughout [400 BLOCK] Hays Mill Road when I encountered what I believed to be illegal activity by the M building. I observed a white male (Hunter Richards) and black male [WITNESS #1] standing closely to a driver door of a silver in color, 2001 Ford Expedition, GA Tag: [REDACTED]. As I approached, I noticed the vehicle was occupied by a white male (Roy Allen).
I observed the three males in close proximity to each other and I believed there to be a hand to hand exchange occurring. I noticed Hunter had a bulge in his waist line and also in his left pants pocket. As I asked what was going on, Hunter appeared to reach in his left pants pocket. I quickly removed Hunter’s hand from the pocket in order to alleviate the possibility of him reaching for a weapon. Hunter was extremely nervous and appeared to not have an explainable reason for being there.
Hunter did explain himself and “T*******” were approached by Roy, who asked to smoke from one of their vape pens. Based on my experience with Hunter, he resides at Nizzear Lane. I found it odd that Hunter would be across town in another apartment complex at this hour. After talking with Hunter, he advised he had some “bud,” known to be marijuana. Hunter reached in his left pants pocket and pulled out a plastic bottle containing a green leafy substance I know to be marijuana. I asked Hunter if he had any weapons on his person before conducting a probable cause search of his person, and he explained he had “something” else on his person. Hunter advised in a cigarette bag in his pocket and he saw there was something inside of there.
I removed the substance and finished my search of Hunter’s person in order to alleviate the possibility of weapons or further illegal narcotics. Inside of a “White Owl” cigarette packet was a white crystallized substance suspected to be methamphetamine. I asked Hunter how he got the methamphetamine, he advised he was walking behind Roy and it was dropped on the ground. Hunter explained he picked up the White Owl packet and put it inside of his pocket. Hunter informed me, himself and [WITNESS #1] looked at it knew it was not something good but was going to wait to throw it away when he got back to his house. I then was given consent to search [WITNESS #1]. However, nothing of interest was found. I separated the parties, and then approached the driver, Roy.
I asked Roy if he had any ingestion devices on his person. Based on my experience with Roy in the past, he is known to use methamphetamine. Roy advised he did not have any ingestion devices on his person. I asked for consent to search Roy, and he gave consent. Roy did advise he had a scale on his person when I asked for consent to search his person. Roy gave consent to search his person. I asked where it was located, he advised his left pants pocket. On Roy’s person was found the following: a zip lock bag containing a large quantity of white crystallized substance suspected to be methamphetamine inside of a cigarette packet, a small black scale, multiple small red zip lock baggies, and $160.00 in 20 dollar bills.
I then detained Hunter and Roy. Both suspects were handcuffed with their hands to the back with palms facing outward, the cuffs were double locked and checked for fit. With parties separated, they were both read their Miranda Rights. I asked Roy what was in the cigarette packet, he said he believed it was methamphetamine. I asked Roy about his methamphetamine use, he advised he has not used methamphetamine in months. I asked Roy whose methamphetamine it was, he advised “Duke Ackey, from [1300 BLOCK] Rainy Road.” Roy explained to me he had it on his person but Duke was supposed to come and pick it up because it was left in his vehicle. When I asked about the money, Roy advised he got the money from an ATM. Roy advised he had a receipt, but the only receipt on his person was from Taco Bell.
I asked Roy about the multiple small baggies in his wallet, and he advised they were to hold coins. I asked Roy if the White Owl packet was his, he advised no. I informed to Roy that Hunter told me it was his, he advised it was not his White Owl packet. I asked [WITNESS #1] how Hunter got the bag of methamphetamine, he advised Hunter picked it up off the ground behind Roy. I asked [WITNESS #1] where he lived, he advised the M building. [WITNESS #1] explained Roy was his neighbor and Hunter was hanging out with him. [WITNESS #1] advised they walked over to Roy’s vehicle in order to talk. Roy would explain he paid $280.00 for the methamphetamine. Roy advised he only used methamphetamine for personal use, and the bag would last him 6 months. When asked how much methamphetamine Roy uses daily, he advised “0.12 grams.” When asked if Roy was selling methamphetamine, he advised no. Roy could no explain the small zip lock bags other than saying he placed coins in them.
It should be noted, Roy only had common change on his person, none of which were inside of any zip lock bags. Hunter would explain Roy offered to sell him methamphetamine. When I asked Hunter how much Roy offered the methamphetamine to him for, he advised they did not get that far into the conversation because he told Roy “hell nah” as I was walking up. I asked Hunter again about the methamphetamine on his person, he advised it was picked up off the ground behind Roy. Hunter advised Roy wanted Hunter to come see something he had inside of his vehicle. Hunter advised when he was at the vehicle, it was methamphetamine that Roy wanted Hunter to see. Hunter advised Roy kept telling him to buy the methamphetamine while he was there. Hunter informed me he did not run away from Roy because he did not want Roy to shoot him because he was “geeked out.” Hunter explained the marijuana (2.0 grams) was mixed with the hemp in the plastic bottle he had in his left pants pocket.
The following evidence was collected at 01:20 hours and dropped into Evidence Locker 019 at 03:00 hours:
- 226A (x1) Zip Lock bag containing a white crystallized substance suspected to be methamphetamine
- 226B (x1) Black and silver cellphone inside a black phone case
- 226C (x1) White crystallized substance suspected to be methamphetamine
- 226D (x1) Green leafy substance suspected to be marijuana
Given Roy’s possession of a large quantity of methamphetamine (27.52), small black scale, multiple small zip lock bags, $160.00 in 20 dollar bills, and Hunter being in direct possession of methamphetamine and having noted Roy attempted to sell it, Roy was charged with 16-13-30(B), Possession with Intent. Warrants have been typed and are pending a signature from a judge. Digital photos attached, Nothing further, Ofc.
