On 02/12/2025, around 2300 hours, I was conducting a routine patrol in the city of Carrollton. I observed a white Chevrolet Impala Georgia tag-[REDACTED] drive across Alabama Street to Burson Avenue. I turned right to follow the vehicle and realized that it covered a considerable distance in a short amount of time. I sped up to catch up to the car to try to read the tag on the vehicle. I turned right and followed them on Lovvorn Road. I observed the vehicle hit its brakes abruptly, going down Lovvorn Road. The passenger threw a plastic sack that looked white out the passenger window, roughly the size of a baseball. Due to the driving behavior, the sack being a white substance in a plastic bag that I commonly see with illegal narcotics, and it had a cracked windshield, I conducted a traffic stop.
Upon activating my blue lights, the vehicle came to a stop slowly on the right side of the roadway. I approached the driver and observed that it was Shelba Dewberry driving, whom I had encountered in previous encounters. I told her to step out of the vehicle, and she did. I placed her in handcuffs and informed her and the passenger, Jacquavious Kidd, that I saw them throw the drugs out the window. Kidd advised it was just trash but quickly said it was a small amount of marijuana. Both were detained into handcuffs and placed at the front of my car, and Agent Kelly (GBI Taskforce) stood with them while I retrieved my Police K9 to attempt to locate the drugs.
I then retrieved my K-9 partner, Olivia, from my patrol car. I have been a canine handler with a police dog since May 2022, and I was paired with canine Olivia. We have completed an 8-week training course together through Arete Canine. Olivia and I are certified through the nationally recognized organization, National Narcotics Detection Dog Association (NNDDA), in the odors of methamphetamine, cocaine, and heroin. She also is certified in tracking and article searches. We have completed hundreds of drug sniffs and drug searches together. An alert is a behavior change that a drug dog exhibits when her nose gets into the target odor she is trained to detect, which may include a shift in search direction, a change in search speed, a change in body posture, or a change in breathing pattern. When a dog detects an odor for which she is trained, her respiration typically becomes more profound; her mouth will close to put more air through the olfactory nose system, and her sniffing pattern changes. A drug detection dog is also trained to have a final response – a trained indication from an alert. Examples of an active final response include barking, biting, or scratching at the source of the odor. Examples of a passive final response include sitting, lying down, or staring at the source of the odor. Olivia’s usual alert is a combination of passive and sometimes active. She typically brackets the odor, increases her tail wag, attempts to pinpoint the odor, and will go into a sit or lay depending on the height of the source. Sometimes, she will scratch with her front paws and look back at the handler and then back at the odor. Article searches are when a canine searches an area for items that may be contaminated with human scent.
I placed Olivia in her vest and a fifteen-foot leash and gave her the command to search for articles. Olivia began searching the area with her nose to the ground, sniffing. Olivia went down the sidewalk back towards Burson Avenue, where she abruptly snapped her head to her left and, touched her nose on a clear plastic bag. I shined my light and observed a clear plastic bag containing white pills and marijuana around the size of a baseball. I rewarded Olivia and collected the evidence. I then returned and placed the evidence in my patrol car, and conducted a probable cause search of the vehicle. I turned Kidd’s interview over to Agent Kelly’s. Agent Kelly informed me that Kidd admitted to selling narcotics, so I seized his cell phone as evidence as well.
Jacquavious Kidd was placed under arrest and charged with the following:
OCGA possession of a controlled substance with intent to distribute x2
Tampering with evidence
Abandonment of dangerous drugs
Littering
I returned to the Carrollton Police Department and dropped the following into evidence:
210A – Clear bag with suspected marijuana inside
210B – Clear bag with 99 white pills stamped with RP15 Oxycodone
210C – Blue iPhone
