On 03/09/2025 at 1036 hours, I responded to 1046 Alabama Street (Quik Pik) in reference to a 911 hangup. Upon arrival at the Quik Pik, I observed a person, later identified as Julio Diaz, lying on his back in between the gas pumps. I spoke to [WITNESS #1] (Quik Pik Manager), who stated that Julio had entered the store and was being loud and boisterous. [WITNESS #1] stated that Julio was not making any sense and was arguing with customers. [WITNESS #1] ordered Julio to leave the store. Julio left and then entered a few minutes later when he pushed another store employee.
While speaking to the Quik Pik employees, Julio stood up and approached me. Julio was unable to maintain his balance and stumbled multiple times. Julio was waving his arms and was being loud and boisterous. Julio told me several times that everything was okay and that there was no problem. While speaking to Julio I smelled a strong odor of an alcoholic beverage coming from his mouth. I told Julio several times to calm down. After failing to comply with my orders, Julio was placed into handcuffs and detained so I could continue speaking with the Quik Pik employees.
While speaking with [WITNESS #1], he stated that he did not want to press charges, but did want Julio to be criminally trespassed from 1046 Alabama Street (Quik Pik).
Due to Julio disturbing customers and arguing with and pushing the Quik Pik employees, I placed Julio under arrest for Disorderly Conduct – Open Container Public Drunk 66-7 (A)(21). Julio did appear to be in an intoxicated condition in a public place, in which condition is manifest by boisterousness.
Julio was transported to the Carroll County Jail, where he consented to blow into a portable breath analyzer. Julio blew a 0.200 on the portable breath analyzer.
Julio was criminally trespassed from the Quik Pik.
