On December 13, 2025, at approximately 03:00 hours, I, Deputy Eidson, was patrolling the area of Lovvorn Road west bound near the parking lot of 361 Lovvorn Road in my conspicuously marked Carroll County patrol vehicle equipped with emergency lights and siren.

While patrolling this area, I was located behind a grey 2017 Chevrolet Silverado (TAG: [REDACTED], VIN: [REDACTED]). While behind the Chevrolet, I observed the vehicle indicate a right turn signal. When the Chevrolet attempted to conduct the right turn, I observed it swing wide causing the driver side tires to strike and travel over the yellow painted line. I initiated a traffic stop on the Chevrolet for the moving violation by activating my emergency lights which in-turn activated my in-car camera system. I exited my patrol vehicle and conducted a driver side approach on the Chevrolet.

Upon conducting my approach, I met with the driver identified as Dilion Tyree who was accompanied by a passenger identified as Kelly Delaney. I introduced myself and explained the reason for the stop. Upon explaining the reason for the stop, I immediately smelled the odor of alcoholic beverages emanating from within the cabin of the Chevrolet. I observed Tyree’s eyes to be glossy and bloodshot. I asked where Tyree was coming from to which he stated Leopoldo’s. Tyree stated he was going to drop off Kelly at her house. I requested Tyree step out of the vehicle and he complied.

I asked Tyree how many alcoholic beverages he consumed to which he stated four beers. Tyree advised he believed it was 2400 hours. I asked Tyree on a scale of one to ten, one being stone cold sober and ten being the most impaired he has ever been where would he place himself. Tyree stated “probably a two and a half”. IT should be noted while conversing with Tyree, I smelled strong odor of alcoholic beverages emanating from within his person and observed him to have a slight slur. I asked Tyree if I could check his eyes to make sure he was safe to drive. He consented.

Standardized Field Sobriety Testing (SFST)

Horizontal Gaze Nystagmus (HGN): 6 of 6

Tyree was positioned in front of my Carroll County patrol vehicle, on relatively flat and level pavement. Tyree was directed to stand with his feet together and keep his hands by his sides. I asked Tyree if he had any medical conditions or recent head injuries to which he advised he advised no. Tyree was instructed to follow a stimulus with his eyes while keeping his head stationary. Tyree advised he understood the instructions and indicated he was ready to begin the assessment.

  • Tyree had equal tracking and equal pupil size in his left and right eye.
  • Tyree had lack of smooth pursuit in both eyes.
  • Tyree had distinct and sustained nystagmus at maximum deviation in both eyes.
  • Tyree had onset of nystagmus prior to 45 degrees in both eyes.

Vertical Gaze Nystagmus: Not Present

Walk and Turn (WAT): 3 of 8 clues

Tyree agreed he was placed on a relatively flat and level surface. I explained the instructions and demonstrated the evaluation for the Walk and Turn to Tyree. Upon asking Tyree if he understood my instructions, he advised he did.

  • Tyree used his arms to maintain balance.
  • Tyree conducted an improper turn.
  • Tyree missed heel to toe

One Leg Stand (OLS): 1 of 4 clues

I administered the One Leg Stand evaluation to Tyree. I explained the instructions and demonstrated the evaluation. Upon asking Tyree if he understood my instructions, he advised he did.

Portable Alco-Sensor: Positive (0.153)

Due to the results of Tyree’s Field Sobriety, The overwhelming odor of alcoholic beverages emanating from within his person, his admittance to the consumption of alcoholic beverages , his driving manifestations and his physical manifestations, I determined Tyree to be under the influence of alcohol to the extent it was less safe for him to be operating his motor vehicle. Tyree was secured to the front in double-locked handcuffs which were checked for proper fit.

Tyree was searched incident to arrest which yielded no contraband. Tyree was seated in the rear of my patrol vehicle without further incident. While seated in the rear of my patrol vehicle, I confirmed with Tyree he was 21 years old or over and read him the Georgia Implied Consent Notice for Suspects Age 21 and over (DDS-354, 05/2019) verbatim, requesting a state administered chemical test of his breath. Tyree refused. I read the card again requesting Tyree’s blood. He refused.

While relocating to Kelly to tell her she needed to have someone pick her up, Kelly who was highly intoxicated began shouting profanities. I relocated to my car and approximately thirty minutes later, when the Wrecker Service arrived, I relocated back to the Chevrolet, I explained to Kelly she needed to exit the vehicle. She was reluctant however complied. When Kelly opened the door she struck me with it slightly. I told Kelly to talk step over to Tyree and talk to him about getting her a ride.

While I was in my patrol vehicle, Kelly was shouting profanities such as ” Fu*k you and B*tch” while showing her middle fingers in my face. I told her multiple times to step away from my vehicle. Kelly proceeded to walk over to the tow truck driver and get in his face waving her hand around obstructing him from towing the Chevrolet. I secured Kelly to the rear in double-locked handcuffs which were checked for proper fit. Kelly was seated in the rear of my patrol vehicle with Tyree. L&N Wrecker Service towed the Chevrolet.

Tyree was transported to the Carroll County Jail and was booked-in, fingerprinted, and issued citations for O.C.G.A. 40-6-391 and O.C.G.A. 40-6-48. Due to him refusing the implied consent card, I issued him a ALS form. A Carroll County warrant was issued to Kelly for Disorderly Conduct and awaits a judges signature. Both court and violator copies of the citation were placed in Thier property in the jail.
