On 10/5/2024, at approximately 1554 hours, I, OFFICER MERRELL, was dispatched to Wingstop at 103 Mirror Lake Connector Suite [REDACTED] for the report of a physical dispute in progress between customers and employees.
While en route, dispatch notified me the suspects left in a black Lexus with Georgia tag: [REDACTED BY AGENCY]. I ran the tag through the computer in my patrol vehicle. It came back to a black, 2013 Acura ILX 20 Tech. As I pulled into the parking lot, I was unable to locate the suspect vehicle.
I entered Wingstop and made contact with the victim, [VICTIM #1]. [VICTIM #1] advised an order was placed at 1442 hours by the first suspect, KIRIKA MITCHELL. At approximately 1540 hours, Mitchell and her boyfriend, KENDRIC WHITE arrived at Wingstop to pick up their order. After receiving their order and leaving the restaurant, White came back into the store, stating the food was cold and demanding a new order. After removing some of the food items, White and Mitchell took their food and left the restaurant. [VICTIM #1] stated they drove away towards Publix, but immediately backed up in front of the store and came back inside.
After walking in the door a second time, [VICTIM #1] stated White and Mitchell began yelling and cursing at her and several other employees. There were several patrons inside the store at this time. As they continued to yell and curse at [VICTIM #1], she advised White and Mitchell they were not going to redo their order a third time and asked them to leave. [VICTIM #1] stated as she turned around, she was struck in the back by a black, styrofoam container containing fries by Mitchell.
After coming from around the counter, [VICTIM #1] was in the process of telling White and Mitchell they needed to leave when White punched her in the face, knocking her to the ground. [VICTIM #1] advised White and Mitchell approached her while she was on the ground. [VICTIM #1] stated she held up her leg and attempted to kick at both White and Mitchell, fearing she would be attacked by both of them. [VICTIM #1] stated one of the patrons stood up and told them to leave. After White and Mitchell left the store, a white male locked the door behind them. They drove away in the black Acura towards the Publix.
After speaking with [VICTIM #1], I then spoke to the witness, [WITNESS #1]. [WITNESS #1] stated he was seated at a table next to the front counter with his back to the door. After White and Mitchell came in the first time and began yelling and cursing, he asked his wife to switch seats with him so he could see what was taking place. [WITNESS #1] stated White and Mitchell left the restaurant, but came back a second time. After returning, they started yelling and cursing at [VICTIM #1] and the staff. [WITNESS #1] advised he watched Mitchell pick up the container of fries, throw it and hit [VICTIM #1] in the middle of her back. [WITNESS #1] told his wife, who is currently pregnant, to run to the bathroom where it would be safer.
[WITNESS #1] stated as [VICTIM #1] came from around the counter, she as telling White and Mitchell they needed to leave when White punched her in the face, knocking [VICTIM #1] to the ground. [WITNESS #1] stated he stood up and yelled at White and Mitchell to leave the restaurant. After they left, [WITNESS #1] stated he locked the door behind them.
I also asked the manager, [WITNESS #2], if the restaurant had inside video surveillance. She stated there was video, but she did not have access to the cameras. I advised her we will need to see the video once the owner returned to the property. [WITNESS #2] was able to provide me a copy of the receipt for Mitchell and White. On the receipt was Mitchell’s name and a phone number. Using Facebook, I was able to find Mitchell’s Facebook page and she was identified by [VICTIM #1], [WITNESS #2], and [WITNESS #1]. A couple of her Facebook posts had a picture of her and a male that matched the description of White. [VICTIM #1], [WITNESS #2], and [WITNESS #1] were also able to identify the male in the pictures as White.
After returning to the police department. I called the phone number that was attached to the receipt provided by Mitchell. After the number was answered by a female, I identified myself, who I worked for and was calling in reference to the assault that occurred at Wingstop. Mitchell identified herself and proceeded to tell me what occurred. Mitchell admitted to going into Wingstop on two different occasions, but stated she never threw a carton of fries at [VICTIM #1], rather she threw them on the ground. Mitchell further stated White never hit [VICTIM #1], but grabbed her because she felt [VICTIM #1] was coming to harm her. They left the store without any further incident.
While talking to Mitchell, she advised her boyfriend was with her and that is when I was able to positively identify the male as White. His story was consistent with everyone else’s regarding the food order. However, White advised Mitchell never threw fries at [VICTIM #1], but rather on the ground. White further stated, [VICTIM #1] came around the counter in an aggressive manner. White stated he grabbed [VICTIM #1] around her arms to protect Mitchell. After he grabbed her, she fell to the ground. After [VICTIM #1] fell, they left the store.
Warrants were taken out on both Mitchell and White for Disorderly Conduct and Simple Battery against [VICTIM #1].
A written statement, a copy of the receipt, and pictures of White and Mitchell were scanned and placed in the “Linked Files” tab.
