Officer’s Narrative:

On the date of 06/29/2021, around 0238 hours, I, Corporal Cheatwood #266 was patrolling the area of South Street near Maple Street when I observed a red sedan with a passenger side brake light out. I followed the vehicle to Krama Street where I performed a traffic stop. I activated my blue lights to initial the stop.
During this time, I observed movement inside the vehicle. I then learned of a passenger inside the vehicle, moving around. The vehicle continued to slow roll and pass several areas that were safe to pull over. This raised my suspicion as I continued to follow the vehicle.
Upon reaching the driver side of the vehicle, I observed a frantic female, Zakiyah Green. Green was showing multiple signs of nervous behavior. Green’s hands were shaking and she would continue direct eye contact.
I then observed the male passenger, Keoni’s McGruder begin to act defensively about the stop, despite the fact that I hadn’t asked him any questions. Ultimately, I had to have Green and McGruder separate due to the behavior of McGruder.
I asked Green to step out and asked her to check her to make sure she was safe to drive to which she consented. I didn’t find Green to be impaired on alcohol but she stated she had smoked marijuana within the hour.
I asked for consent to search the vehicle to which I was granted. Green was pulled out by Ofc. Brice. Green explained there “shouldn’t be anything legal inside the vehicle. I then began a search to find an edible wrapper in plain view along with the odor of marijuana. When asked about the edible’s wrapper, Green began recanting her consent for me to search. I explained to Green at this time, consent had turned into Probable Cause. Green became upset but the search continued.
Once I got to the rear seat, I located a grey in color Adidas bag. Once I grabbed the bag and returned the rear of the vehicle, McGruder took off running from Ofc. Brice. I then detained Green and called the direction of travel for Ofc. Brice. Shortly after, McGruder was located near Highway 27 and South Street Park.
I began searching the bag that contained men’s belongings such as an overnight bag. Within those items were multiple bags of marijuana of different sizes. These items were dropped into evidence as 266a-266c. A firearm (Glock 19 Serial #BTDG717) was also located. This item was found to be stolen out of the Atlanta Police Department in May (APD case #211462018). This item was collected and placed into evidence as item 266d. A phone was located on the person of McGruder. This phone is believed to hold information involving the selling of marijuana. This item was collected as item 266e. McGruder was found to be in possession of nearly $100 in different dimensions believed to be from the sale of marijuana around the city.
A criminal history of McGruder shows many felony charges although not “convicted” on any besides one under the first offenders act. Thus, led to not charging with McGruder to not being charge with firearm by convicted felon. McGruder has multiple other charges of Possession with intent (marijuana) and theft by receiving stolen property.
Through strenuous investigation, McGruder admitted the grey Adidas back pack was his, however refused to speak anymore and advised he wasn’t talking without a lawyer or allowing me to view his phone without a lawyer. McGruder did make mentions that he paid $800 for the stolen firearm but refused to give any other details.
McGruder was charged with the attached offenses:
Poss. w/ intent (marijuana)
Poss. of firearm during commission of a crime
Theft by receiving stolen property (firearm)
Obstruction of a police officer
Green was written a citation for her equipment violation and released to appear.
All items were dropped into locker 017 at 0425hours.
