OBSTRUCTION OF A POLICE OFFICER

On 3/06/2026 at approximately 0214 hours, I responded to [200 BLOCK] Perry Street in reference to a dispute in progress. Dispatch advised that a subject named Luis was at the residence, would not leave, and was standing in the doorway.

As I was driving down Perry Street, I observed a male matching the description of the individual who had run across the roadway into the backyard of [200 BLOCK] Perry Street. I advised dispatch that I had one running as I pulled up to [200 BLOCK] Perry Street. I quickly exited my patrol vehicle and gave chase, issuing loud verbal commands to stop. I could hear someone in the tree line and continued giving commands to stop. Once I reached a clearing in the tree line, I observed a male, later identified as Luis Daniel Rivera Lopez, attempting to climb the backyard fence. I drew my department-issued Taser (X40019MEA) and gave Luis commands to get on the ground. Luis did not comply. I repeated my commands for Luis to get on the ground and put his hands behind his back. Luis again refused to comply and, at one point, appeared as though he was going to run.

I continued issuing commands for Luis to put his face in the dirt and his hands behind his back. Luis finally complied and lay face down on the ground. I had to keep ordering Luis to keep his hands behind his back until backup arrived. Ofc. Head arrived and placed Luis in handcuffs, double-locked and checked for fit, then escorted Luis to the front of my patrol vehicle.

I attempted to speak with Luis and immediately noticed a strong odor of alcohol on his breath. Luis was unable to stand up straight. When I asked Luis why he was running, he stated that someone was trying to set him up. I then asked if he was at [200 BLOCK] Perry Street and whether he had been asked to leave. Luis replied that he had not been asked to leave, claimed he was using the phone, and said it was a friend’s house. Luis continued to mumble and was incoherent.

I then returned to [200 BLOCK] Perry Street to speak with the complainant, [VICTIM #1]. [VICTIM #1] confirmed that Luis was at the house, had walked there from the square, and needed to use the phone. She stated that Luis positioned himself in the doorway and refused to leave despite multiple requests. [VICTIM #1] said she attempted to push Luis out of the house, but due to his size, she was unable to move him. She told Luis that she was on the phone with 911, at which point he ran from the residence. I asked if she wished to prosecute, and she indicated that she did not.

I returned to the front of my patrol vehicle and advised Luis that he was under arrest. Luis was evaluated and cleared by West Georgia Ambulance for minor cuts and scrapes sustained while attempting to jump the fence and landing in the treeline. Ofc. Head transported Luis to the Carroll County Jail, where he was booked and charged with the following offenses:

Disorderly Conduct/Public Drunkenness C66-7(A)(21)
Obstruction of a Police Officer C66-7(A)(22)

Luis was charged with Disorderly Conduct/Public Drunkenness because he was intoxicated in public and inside another person’s residence. He was charged with Obstruction of a Police Officer for running after being made aware of law enforcement presence and for failing to comply with lawful orders.
