Officer’s Narrative:

On December 31, 2025 at approximately 14:06 hours, I, Officer S. McKinnor, was patrolling the parking lot of 195 Commerce Drive at the Super 8 in my conspicuously marked patrol vehicle, when I observed a gray 2019 Lexus ES (GA Tag [REDACTED BY AGENCY], VIN: [REDACTED BY AGENCY]) with a black male sitting in the driver seat.
I observed a hispanic male holding a hammer while arguing with the black male who was sitting in the driver seat of the Lexus. The hispanic male holding the hammer was later identified as Nelson Bustillo. The black male sitting in the Lexus was later identified as Stevie McGhee.
I observed Bustillo holding the hammer in his right hand lifted up towards his side while pointing his left finger towards McGhee who was still sitting in the driver seat. The way Bustillo was yelling and his positioning of the hammer, it seemed as if Bustillo was preparing to strike McGhee.
Due to the heated situation I observed unfolding and the apparent assault about to take place, I intervened by parking my vehicle in front of the incident. I observed the two individuals cease arguing. I observed Bustillo switch the hammer from his right hand to his left, lowering it from its original threatening position.
At this point it seemed as if both parties became nervous or frightened by my law enforcement presence. It seemed as if both Bustillo and McGhee were both involved with the altercation. Due to the yelling and the apparent tumultuous and violent manner in which Bustillo was holding the hammer, I began an investigation into DISORDELY CONDUCT – OCGA 16-11-39, AFFRAY – OCGA 16-11-32 and or AGGRAVATED ASSAULT – OCGA 16-5-21.
I observed both Bustillo and McGhee shake each other’s hands as they awkwardly smiled at each other. Bustillo dropped the hammer, placing it on a rock bed to his left. The handshaking seemed staged and fake, as it appeared McGhee did not want to shake his hand.
I observed sweat coming from Bustillo’s forehead, even though it was in the thirty-degree temperatures outside. This made me suspect Bustillo was exerting physical energy prior or as I approached the two males, I also observed sweat coming from McGhee’s forehead also indicating possibly something physical has happened.
I asked Bustillo why he had a hammer in his hands. Bustillo explained he had seen “him” referring to McGhee, from his room window. Bustillo advised he grabbed the hammer because he was doing work in his home. Bustillo explained he had been living in the Super 8 for approximately three months.
I asked both of them how they knew each other but neither could give an explanation. McGhee looked around as if he could not give answer as to how he knew Bustillo. Bustillo advised he sometimes observed McGhee in the parking lot at the Super 8 but that was the extent of their relationship.
I started to suspect other criminal activity could be afoot due to the Super 8 being a high crime area. I personally come across individuals monthly and or weekly who are involved with illegal sales or possession of illegal narcotics while at the Super 8. From my experience I have seen individuals using their vehicles to park at the Super 8 and other hotels/motel in order to purchase or sale illegal narcotics.
McGhee explained he did not live or stay at the Super 8, which caused me to question why he would be parked at the business. This was another strong indicator of illegal narcotic activity due to individuals commonly loitering at hotels or motels, which a lot of times they don’t even stay at.
I observed McGhee begin making movements below his waist as if he was either retrieving or attempting hide something. I knew these movements to be suspicious due to my past experiences with subjects retrieving firearms or hiding evidence.
Also knowing just prior to my arrival that an altercation was occurring with a hammer present, I reasonably assumed that McGhee could be armed himself. I relocated closer to the driver window while retrieving the tag number. I did this in an attempt to see what McGhee was hiding or concealing from me. A quick pass by of the driver window allowed me to see his waist, where I did not observe a weapon.
I observed McGhee moving hands towards his pockets, which would later confirm he had hid evidence from me. I began suspecting maybe the altercation involved illegal narcotics activity due to the area and the circumstances revolved around what I had observed. At this point both individuals were detained for further investigation.
Due to my initial radio traffic consisting of a possible dispute involving a hammer, other additional units arrived on scene for assistance. The metal Dewalt hammer with a yellow grip was removed from the proximity in order to prevent any further assaults or conflicts.
Bustillo was placed at the outside rear of my patrol vehicle with another officer while I relocated to McGhee who was still sitting in the Lexus. I asked McGhee approximately four times to exit the vehicle so I could conduct my investigation, separating him from the vehicle.
Due to the suspicious movements I had earlier observed McGhee conducting in the Lexus, I needed McGhee away from the vehicle in case a weapon was near his driver seat. McGhee refused to exit the Lexus approximately four times asking why he was being detained. McGhee finally exited the Lexus becoming very compliant.
I asked for consent to conduct a pat down on McGhee’s person for weapons which he allowed, yielding no weapons. Since the driver door of the Lexus was opened, I could in plain view see tobacco leaves rolled in a way commonly seen with the way marijuana users roll their “joints” or cigarettes. I began suspecting possible marijuana usage.
McGhee was relocated to the walking path which was alongside the Super 8 building. I asked McGhee how he knew Bustillo, to which he replied in a concerning manner “I don’t know this guy”. I immediately took this as alarming due to me observing Bustillo and McGhee shaking hands while implying, they knew each other. This made me suspect McGhee or Bustillo were being deceptive or maybe both.
I explained to McGhee the circumstances around why I detained them both and how suspicious it was to which McGhee agreed to being suspicious. I asked McGhee why he had been approached by Bustillo. McGhee explained Bustillo approached him asking if he was the person following his mother.
I asked McGhee if Bustillo was intimidating him with the hammer, to which he explained yes he was intimidated. McGhee explained he did not know Bustillo at all. I asked McGhee why he was sitting in the parking lot of the Super 8. McGhee advised he was driving the Lexus on the roadway while texting and being on the cellphone with his brother.
McGhee seemed disheveled while replying to me, pausing intermittently, making me suspect he may be fabricating his story. I found it odd that he would go so far out of his way from the roadway and park his vehicle in the back right corner of the Super 8, just to text/talk to his brother.
There was almost no vehicles in the Super 8 parking lot at the time, meaning there were plentiful places for McGhee to park. This explanation of McGhee was not making sense to me and made me suspect even more he was also involved with criminal activity. I began suspecting McGhee was possibly attempting to smoke marijuana, purchase it or even sell the substance. McGhee admitted he and Bustillo were arguing, which confirmed what I had earlier observed.
Knowing I had observed Bustillo holding the DeWalt hammer in a threatening manner towards McGhee and the admittance that they were both involved in a verbal dispute I began to suspect even more that Bustillo’s intentions were to harm McGhee. I informed other officers on scene to detain Bustillo in handcuffs for further detention. Bustillo allowed me to search him, yielding no weapons or illegal contraband. Bustillo was placed in the rear of my patrol vehicle.
Bustillo was advised of his Miranda warning, to which he agreed to speak with me. Bustillo explained his mother had been telling him about a man who had been following her. Bustillo advised he had seen the male, referring to McGhee, numerous times following his mother around. Bustillo explained prior to his encounter with McGhee, he had observed him from his hotel room window at the Super 8.
Bustillo advised he had been wearing his toolbelt since he works construction, so he decided he would confront McGhee for the alleged stalking of his mother. Bustillo could not give a good explanation for why he brought the hammer down with him to confront McGhee.
I observed McGhee to be wearing clean clothes with nice leather dress shoes, indicating he had not been working construction, which is usually a very labor intensive job involving dirt and other messy materials. Bustillo advised he has observed McGhee several times parked in the parking lot of the Super 8 seeming to be watching guests as they left the parking lot.
Bustillo seemed concerned when speaking about McGhee as if he was harboring some anger towards him. [BUSTILLO] hinted he has watched McGhee several times loitering in the back parking lot with stranger coming and going from his vehicle.
At this point I recognized Bustillo as a person of interest from a felony terroristic threats case involving our criminal investigations department. [BUSTILLO] was caught on video footage verbally assaulting a gas station worker within the city of Villa Rica, threatening the worker with bodily harm. This made me suspect Bustillo may have some anger issues if this is was a reoccurring issue.
Due to me observing Bustillo holding the hammer in a pre-strike position while being involved in a heated verbal dispute and Bustillo’s admission that he premediated a confrontation with McGhee due to him allegedly stalking his mother, I believed from my training, knowledge and experience that he had committed aggravated assault on McGhee.
Even though Bustillo did not physically strike McGhee, the act of him being in a pre-strike position with a metal hammer, which could produce great bodily harm or death if used against a human being, he committed the act of Aggravated Assault – OCGA 16-5-21. A later criminal history revealed Bustillo had a history of assaults and domestic violence, which only greater provides more motivation for his true intentions towards McGhee with the hammer.
McGhee did not want to press charges against Bustillo for aggravated assault. Due to the tumultuous and violent manner in which Bustillo was using the hammer towards McGhee in a public place and McGhee feeling threatened by it, Bustillo was arrested for Disorderly Conduct – OCGA 16-11-39.
Due to my earlier observation of the loose tobacco leaves being in the Lexus and my suspicions of marijuana usage, I asked if McGhee smoked marijuana. McGhee advised he does actively smoke marijuana but none of the substance was in the Lexus. McGhee explained there was marijuana in the Lexus at some point.
McGhee did not give me consent to search his vehicle. I relocated to the driver side of the vehicle, never entering it in anyway. I observed plain view which I did not see initially, small, fragmented pieces of marijuana laying on the driver seat where McGhee was sitting.
I informed McGhee of the newly discovered marijuana on the driver seat, advising I would be searching his vehicle for more of the substance. A probable cause search of the Lexus yielded fragmented pieces of marijuana on the driver seat, driver floorboard and the back left passenger floorboard. A white plastic hollow tube device with a white crystallized substance seen in the tube was located in the center console.
I believed from my training, knowledge and experience with illegal narcotics that the substance within the white plastic tube was methamphetamine. Due to the marijuana being located in the Lexus and the fair probability of McGhee having more of the substance on his person, a probable cause search of his person was conducting, yielding approximately two grams of marijuana contained in a cellophane baggy in his left pants pocket. No other illegal contraband was located on McGhee’s person.
I believe my earlier observation of McGhee making suspicious movements towards his pockets or waistband were due to him hiding the marijuana. McGhee once again reiterated he did not want to press charges against Bustillo but he had felt threatened by the hammer. McGhee was released at the scene with a city citation for Possession of Marijuana Less Than One Ounce – OCGA 16-13-2B.
Due to my observation of the aggravated assault being committed by Bustillo with the hammer towards McGhee, [BUSTILLO]’s apparent anger towards McGhee due to him allegedly stalking his mother, [BUSTILLO]’s criminal history involving assault, I believed Bustillo had every intention of using the hammer to cause great bodily harm or death to McGhee.
Knowing this and the totality of the circumstances, I charged Bustillo with POSSESSION OF TOOLS FOR THE COMMISSION OF A CRIME – OCGA 16-7-20. I believe Bustillo would have used the hammer to strike McGhee if I had not come upon their verbal dispute, therefore making the hammer a tool for the commission of a crime.
The metal Dewalt hammer with a yellow grip was seized along with the marijuana found on McGhee’s person. Bustillo was transported to the Carroll County jail for housing.
Two Carroll County warrants for Bustillo were signed by a judge, including,
- POSSESSION OF TOOLS FOR THE COMMISSION OF A CRIME – OCGA 16-7-20
- DISORDELY CONDUCT – OCGA 16-11-39
The metal DeWalt hammer with a yellow grip was wrapped in bubble-wrap, bagged, sealed and placed into evidence under receipt number “VR-019479′.
The approximate two grams of marijuana along with the cellophane baggy was bagged, sealed and placed into evidence under receipt number “VR-019278”.
