On 2/28/2026 at approximately 21:47 hours, I was dispatched to [600 BLOCK] Blackshear Trl in reference to a domestic in progress call. Upon arrival I made contact with Ogheneovo Evwierhoma and Kelsey Maddox. Mr. Evwierhoma and Mrs. Maddox were screaming at one another when I arrived on scene. I seperated Mr. Evwierhoma and Mrs. Maddox from one another and started my investigation into what happened between the two.

Mrs. Maddox stated that Mr. Evwierhoma beat her in the head and bit her nose off. Mrs. Maddox had a chunk of meat missing from the end of her nose and was bleeding from her right eye with some swelling around her eye as well. I detained Mr.Evwierhoma, placing him in handcuffs, making sure they were properly applied with the double locking mechanism engaged. I placed Mr. Evwierhoma in the back of my patrol Vehicle while Cpl. Alexander placed Mrs. Maddox in the back of his patrol vehicle( Not Handcuffed). I read Mr. Evwierhoma maranda rights at which time he agreed to talk with me and answer my questions.

I asked Mr. Evwierhoma about what happened. He stated that Mrs. Maddox asked why he had an attitude problem and then struck him on the head. Mr. Evwierhoma then advised that he struck Mrs. Maddox in the head and asked her how she liked being hit. Mr. Evwierhoma stated Mrs. Maddox began screaming at him and started choking him and scratching him, leaving visible scratch marks on his arms and chest and a small laceration on his left arm. Mr. Evwierhoma advised that he bit Mrs. Maddox’s nose and struck her in the face, causing Mrs. Maddox to bleed from her nose and her right eye.

I walked to Cpl. Alexander’s patrol vehicle and advised dispatch to have EMS en route for Mrs.Maddox’s injuries. Mrs. Maddox stated that Mr. Evwierhoma struck her in the face and head and bit her nose off, and advised that he put his hands on her first when the altercation started. I returned to [600 BLOCK] Blackshear Trl and spoke with witness [WITNESS #1], who stated she heard screaming and knew that the couple’s 14-month-old child was downstairs with them, so she went to take the child upstairs.

[WITNESS #1] stated she heard Mr. Evwierhoma tell Mrs. Maddox You hit me, now I’m going to hit you then she went upstairs with the child. I returned to my patrol Vehicle and advised Mr. Evwierhoma that he was under arrest and going to jail and being charged with Aggravated Battery, 0.C.G.A. code 16-5-24, and Cruelty to Children in the third degree, and that it would fall under the Family Violence Act. I walked to Cpl. Alexander’s Patrol car and advised Mrs. Maddox that she would be under arrest for Battery O.C.G.A 16-5-23.1 and Cruelty To Children in the third-degree, falling under the Family Violence Act.

I made sure that Mr. Evwierhoma was seatbelted in. I then transported Mr. Evwierhoma to the Carroll County Jail and turned him over to the Carroll County Jail staff. Mr. Evwierhoma refused any medical treatment for his injuries sustained in the altercation. Cpl. Alexander was waiting at Tanner Medical Center in Villa Rica with Mrs. Maddox, who was getting medically cleared for her injuries. I relieved Cpl. Alexander at the hospital and waited for Mrs. Maddox to be medically cleared.

Once Mrs. Maddox was medically cleared, I placed her in handcuffs, making sure they were properly applied with the double locking mechanism engaged. I walked Mrs. Maddox to my patrol Vehicle and placed her in the back seat, and seat belted her in. I transported Mrs. Maddox to the Carroll County Jail and turned her over to the Carroll County Jail staff, along with Mrs. Maddox’s discharge papers from the hospital.

I returned to service and returned to the Temple Police Department to complete all necessary paperwork and complete the warrant process. Clerk [REDACTED], Lt. Christopher Parrish, SGT. Charles Thompson and Cpl. Mitchell was notified of the arrest and charges via email. Once I completed the paperwork, I returned to service for calls.

Case History:

2/28/26

BOOKING AND ARREST

What this means: Ogheneovo Evwierhoma was booked into custody in Carroll County on this date. Evwierhoma is accused of Aggravated Battery and Cruelty to Children (Third Degree — allowing a child to witness a felony, battery, or family violence). These are the charges the case is built around in Carroll Superior Court, Case No. SUWA2026000194.

3/5/26

PUBLIC DEFENDER ENTERS THE CASE

What this means: The Office of the Public Defender for the Wire Georgia Judicial Circuit filed a formal Entry of Appearance in Carroll Superior Court, notifying the court that it would be representing Ogheneovo Evwierhoma. The filing was signed by attorney S. Logan Johnston and references Standing Order No. 7, which governs how the Public Defender’s office handles notices and scheduling in Carroll County cases.

3/20/26

SUBSTITUTION OF COUNSEL

What this means: The law firm Duke & Heath, Attorneys at Law, filed a Notice of Substitution of Counsel, replacing the Public Defender as the legal representation for Ogheneovo Evwierhoma. Going forward, Timothy A. Heath — located at 539 Newman Street in Carrollton, Georgia — is listed as attorneys for Evwierhoma in Case No. 26-WA-194.

3/20/26

WAIVER OF ARRAIGNMENT AND PLEA OF NOT GUILTY ENTERED

What this means: Ogheneovo Evwierhoma, through attorneys at Duke & Heath, formally waived the right to appear in court for an arraignment hearing and entered a plea of not guilty. This is a common procedural step that allows the case to move forward without requiring Evwierhoma to appear in court just to enter that plea. Evwierhoma maintains a legal presumption of innocence at this stage.

3/20/26

NOTICE OF ELECTION TO PROCEED UNDER GEORGIA’S DISCOVERY STATUTES

What this means: Duke & Heath filed a Notice of Defendant’s Election to Proceed under O.C.G.A. § 17-16-1 et seq. on behalf of Ogheneovo Evwierhoma. This means Evwierhoma has formally opted into Georgia’s reciprocal discovery process, which requires both the prosecution and the defense to share certain evidence with each other before trial. By electing into this process, Evwierhoma’s legal team is also signaling to the prosecution that they are prepared to engage in the evidence-sharing process as provided by Georgia law.

3/20/26

MOTION FOR DISCOVERY FILED

What this means: Duke & Heath filed a Motion for Discovery asking Carroll Superior Court to require the prosecution to turn over a broad range of materials related to Case No. 26-WA-194. The request includes a copy of the indictment or accusation, a list of witnesses, all police reports, any statements made by Ogheneovo Evwierhoma, all written scientific reports, any video or audio recordings, all physical evidence, and any material that could help the defense — known legally as Brady material, referring to the U.S. Supreme Court ruling in Brady v. Maryland, which requires prosecutors to disclose evidence that could be favorable to the defendant. The case updates also reflect separate related motions filed the same day for disclosure of items arguably subject to the defense and for witness information.

3/20/26

OBJECTION TO WRITTEN WITNESS REPORTS FILED

What this means: Duke & Heath filed a formal objection on behalf of Ogheneovo Evwierhoma under O.C.G.A. § 24-3-1561, notifying the court and the prosecution that Evwierhoma objects to any written reports from witnesses being introduced as evidence at trial. The filing also demands that any witness testimony be presented live — through the witness themselves — unless Evwierhoma’s attorneys and the prosecution specifically agree otherwise on the record. Additionally, the defense is requesting that all notes, memoranda, and materials used by the crime lab be produced and available at trial.

3/20/26

MOTION FOR ADDITIONAL TIME TO FILE MOTIONS

What this means: Duke & Heath filed a motion asking Carroll Superior Court to give Ogheneovo Evwierhoma’s legal team an additional 10 days — starting from the date the prosecution provides discovery materials — to file any further motions. The attorneys noted that this request is being made before arraignment and before they have received discovery from the State, meaning they may need more time once they review the evidence to determine what additional legal arguments to raise on Evwierhoma’s behalf.

3/26/26

APPEARANCE BOND SET

What this means: An Appearance Bond was issued in Carroll County for Ogheneovo Evwierhoma in Case No. 26-WA-194. This is a financial agreement that allows Evwierhoma to remain out of custody while the case proceeds, on the condition that Evwierhoma appears for all required court dates. The bond document includes standard conditions and warnings that failure to appear could result in the bond being forfeited and a warrant being issued.
