On May 31, 2026 at approximately 23:04 hours, I, Officer Birdyshaw, was dispatched to [REDACTED] in reference to a domestic dispute in progress.

Prior to my arrival, other units were already on scene.

Upon my arrival, in a conspicuously marked Villa Rica Police Department patrol vehicle, equipped with emergency lights and a siren, and with my body worn and in car camera activated, I made contact with a male who was speaking with Officer Roseberry. The male, later identified as Shamir Culbreath, advised he was in an argument with his girlfriend, later identified as [VICTIM #1], over messages she had discovered in his cell phone. Culbreath advised [VICTIM #1] was telling Culbreath to “get his stuff” and telling him ” he has to go.” Culbreath advised the altercation was not physical and was throwing his belongings as she was telling him to leave. Culbreath advised nothing was broken during the altercation. Culbreath advised he does live with [VICTIM #1].

While speaking with Culbreath, Sergeant Waldo collected photographs of Culbreath’s person. Sergeant Waldo then advised me that [VICTIM #1] had sustained an injury to her lip, which was open and actively bleeding. Sergeant Waldo advised me that Culbreath advised Adam’s had sustained the injury the day prior while playing Volleyball.

After gathering Culbreath’s information, I provided his information to dispatch, and dispatch advised me that Culbreath had a warrant through Gwinnett County Sheriff’s Office, which was later confirmed, and Gwinnett County did place a hold.

I then relocated to speak with [VICTIM #1], who initially advised she did not know how she had sustained a busted lip, and when I asked further clarifying questions, [VICTIM #1] advised her busted lip “might have” come from the altercation. I was able to observe her lip to have a fresh and open wound, which was actively bleeding, additionally I observed a faint scratch to her left cheek. [VICTIM #1] advised that she and Culbreath got into an argument, which prompted her to slam her door. [VICTIM #1] advised that she believed her slamming the door is what prompted her daughter, [REDACTED BY AGENCY] (9 years of age), to call for law enforcement. [VICTIM #1] then advised she had injured her lip earlier, and it had been bleeding “on and off’ throughout the day. [VICTIM #1] advised her children “probably heard us arguing.”

I then relocated inside of the residence to speak with [REDACTED BY AGENCY] (11 years of age), and [REDACTED BY AGENCY] advised she heard “yelling and banging” during the argument. [REDACTED BY AGENCY] also advised she heard the “yelling and banging” during the argument.

Officer Holder then advised me he had collected the information for [VICTIM #1], [REDACTED BY AGENCY].

I then relocated to Culbreath, where I then placed him under arrest for the warrant through Gwinnett County Sheriff’s Office. I then secured Culbreath’s arms to the rear of his person, and secured him in handcuffs, which were checked for proper fit and double locked. I then conducted a search incident to arrest on Culbreath’s person, and no contraband was located during the search. I then secured Culbreath in the rear passenger seat of my patrol vehicle, which was duty checked after my previous transport at 22:45 hours and found to be free of damage or contraband. Culbreath was secured by a seat belt and separated from the driver’s compartment by the department issued metal and Plexiglas barrier of the patrol vehicle. I then requested Sergeant Waldo to standby with Culbreath as I relocated to speak with [VICTIM #1] further.

At this time Officer Roseberry returned to the scene and informed me that when he spoke with [VICTIM #1] and Culbreath, their accounts of how [VICTIM #1] sustained the injury to her lip were different from one another’s. Officer Roseberry advised me that [VICTIM #1] had stated “He may have hit me when he moved me accidently.” I then continued to relocate and speak with [VICTIM #1].

Upon speaking with [VICTIM #1] further, [VICTIM #1] advised “I could have hit myself, he could have hit me by accident, trying to get me out of the way.” I then asked [VICTIM #1] how Culbreath “tried to get her out of the way,” to which she advised he had grabbed her, and she grabbed him back. [VICTIM #1] advised that Culbreath lives with her on and off, and does receive mail at their shared residence.

From the testimony of the involved parties and evidence gathered on scene, Culbreath identified as the predominant aggressor, and was charged with Battery Family Violence and two counts of cruelty to children in the third degree.

Officer Holder provided [VICTIM #1] with a case card and resources regarding family violence. Additionally, Officer Holder advised me ha had collected photographs of [VICTIM #1] person. Additionally Officer Holder advised me that he had observed fresh and dried blood on her right leg.

I then returned to my patrol vehicle, where I then read Culbreath his Miranda Warning, verbatim, from my Villa Rica Police Department issued Miranda Warning Card. Culbreath agreed to continue speaking with me with his Miranda Warning in mind. I then asked Culbreath clarifying questions in regards to how [VICTIM #1] sustained the injury to her lip, to which Culbreath did not provide any further clarifying information. IT should be noted, Culbreath did state [VICTIM #1] was instructing her daughters to call the police, which is in contradiction to the statements of [VICTIM #1] and her daughters.

I then entered into the driver seat of my patrol vehicle, securing my own seat belt, and transported Culbreath to Carroll County Jail for housing.

Three Carroll County Warrants for Culbreath have been completed and signed by a judge.
