At the date and time above, I, Officer Acord, conducted a traffic stop on Adamson Square. The stop was unrelated to the subsequent threat report from Carroll County Dispatch. During the stop, Dispatch reported a male threatening to shoot up the Irish Bread Pub and claiming to be a member of the Bloods. Dispatch described one male as wearing a hoodie and a yellow hat. I returned the driver’s ID and informed him he was free to leave.
I proceeded across the street to the pub and observed the male in the yellow hat standing next to a tall Black male wearing a baby blue hoodie (later identified as Victor Cleveland). The male in the blue hoodie was yelling at another individual and had to be physically restrained from engaging in a fight. Despite this, he continued trying to provoke the other party, whom I could not see. Victor was yelling, raising his arms, and pointing at the other party. This is common behavior from persons attempting to provoke fights. While Victor was doing this, several people in the background could be heard telling him to “chill”.
Upon seeing me, the male began to walk away. I told him that he was not going to leave. The man in the yellow hat protested and stated that they were going home. I informed them that this was not an option due to the disorderly conduct I had observed. Specifically, Victor Cleveland, the male wearing a blue hoodie, was yelling loudly and attempting to initiate a physical altercation.
Victor continued to pull away despite being told he was not leaving. I told Victor to place his hands behind his back, but he did not comply. I repeated this command approximately five times before I was finally able to get his hands behind his back. However, while attempting to secure the handcuffs, he once again pulled away, breaking free from my grip.
Due to the size difference, his willful obstruction, and his prior attempt to engage in a physical altercation, I placed my arm around Victor’s back and pulled him to the ground. Once Victor was on the ground, the other male began to approach me. I unholstered my taser and instructed him to back up. Security for the pub, seeing that I was alone, moved the male away from me so I could focus my attention on the male I had pulled to the ground.
Shortly after, I was able to get Victor on the ground. Several more units arrived, helping me get him into handcuffs that were double locked and check for proper fitment. Upon searching him incident to arrest, we were able to locate his wallet, inside which was his ID.
After the situation calmed down, I spoke to Victor, who stated that he was just trying to break up his little brother up from fighting. I explained my observations to him, and he denied provoking and engaging, but agreed that he was obstructing.
The male in the yellow hat was later identified at [REDACTED]. There was no evidence at the time that he was attempting to engage in the fight. He was let go with out further indent.
After this, I spoke to [WITNESS #1]. [WITNESS #1] told me that he was the one who originally called, and began to explain to me his observations of the incident. I asked him to identify the subject who stated that he had to shoot up the place, and he pointed out Victor.
[WITNESS #1] told me that he was with the guy in the yellow hat after he got into an argument with a white male. While he was speaking with the male, Victor approached him and began to yell at him, stating that [WITNESS #1] needed to get out of his face, he did not care, and that he was a member of the Bloods. After that, [WITNESS #1] said that Victor threatened to shoot up the pub. [WITNESS #1] said after the threat was made, he removed himself and called 911.
Victor was arrested and charged with the following:
