On Monday December 12th 2022 Deputy Kuzma was dispatched to the listed address in reference to a domestic dispute between a husband and wife, while en route to the call dispatch advised that the female had obstructed the complainants phone call to 911 by taking the phone away from him. Deputy Kuzma arrived on scene and met with the wife [offender] who was walking to her car where her niece and nephew were inside.
Deputy Kuzma asked the offender what happened and she said that her and her husband [complainant] both hit each other and were going to jail. Deputy Kuzma asked her again what had happen and she was yelling to Deputy Kuzma trying to tell him what happen, Deputy Kuzma had the offender take a deep breath and asked for her I.D and asked where the complainant was at. The offender said that the complainant was by the car port door, Deputy Kuzma had the offender stay where she was at and went and talked to the complainant.
The complainant said that he had just got out of the shower and the offender came into the bathroom and was upset about a upcoming court date that she has in reference to custody of her kids. The complainant said that when he asked about the court date she got mad and started to hit the complainant using a close fist and had busted his lip. Deputy Kuzma did observe the complainant having a busted lip consisting with his story.
The complainant said he was on the phone with 911 as the offender was hitting him and she got the phone and threw the phone outside in the front yard causing damage to it. Deputy Kuzma did find the complainants cell phone near the front porch lying on the ground with the back part of it missing exposing the battery.
Deputy Kuzma went back over to the offender to get her side of the story. The offender stated that the complainant had hit her and grabbed her throat so she hit him to protect herself from him. Deputy Kuzma looked at the offenders face and neck area and did not see any marks on her. When Deputy Kuzma asked the offender about the complainants phone “she said that he dropped it like an idiot”.
Based on the physical evidence of the complainants lip and the offender having no marks on her and the offenders story about her not damaging the complainants phone even though her story stated that he dropped it when they were fighting in the bathroom and the phone was found outside near the front porch Deputy Kuzma determined that the offender was the primary aggressor.. Deputy Kuzma took pictures of the phone and the complainants lip and will attach them to his report. The complainant was giving this report number and the process on how to obtain a TPO if he wanted one.
The offender was handcuffed, the cuffs were double locked and checked for fit. The offender was searched for weapons and contraband with none found. Deputy Kuzma transported the offender to detention and turned her over to jail staff without any issues. Deputy Kuzma checked his car before and after transport for contraband with none found.
