On October 18th, 2025 at approximately 9:17 AM, I was dispatched to [1400 BLOCK] Audubon Dr, in reference to a female being assaulted. The reporting party (An unknown third-party witness) advised that a male wearing a gray long-sleeved shirt was assaulting a female and a little girl was screaming, “Why would you do that to my mom”. My body-worn camera was activated.
Upon arriving on scene, I heard a female crying inside the home. I knocked on the side door and a B/M wearing a gray long-sleeved shirt appeared from the back of the home. The male, later identified as Benjamin Kinlaw, told me that everything was fine. I told Mr. Kinlaw that someone had called in an assault that occurred at his residence. Mr. Kinlaw escorted me to the backdoor and advised that his wife was inside and gave me permission to enter the home to speak with her. At this time, CPL Huynh arrived on scene. CPL Huynh stayed with Mr. Kinlaw, while I entered the home to locate the female party.
I followed the sound of a female crying to the back bedroom of the home. I saw a B/F with her knees on the ground, hunched over a bed crying. The female, who identified herself as [VICTIM #1], advised her back was hurting and wanted to go to the hospital. EMS was immediately dispatched.
I proceeded to ask Ms. [VICTIM #1] how she sustained her injury, to which she replied her boyfriend, Benjamin Kinlaw, gave her $198 in cash yesterday. Ms. [VICTIM #1] stated this morning, he told her to give her the money back and an argument ensued. Ms. [VICTIM #1] stated Mr. Kinlaw then grabbed her car keys and cell phone and walked outside to leave in her car. Ms. [VICTIM #1] stated she followed him outside to retrieve her cell phone, when Mr. Kinlaw picked her up and slammed her onto the driveway. Ms. [VICTIM #1] advised she walked back into the home and into the bathroom. Ms. [VICTIM #1] advised she then walked out of the bathroom and into their bedroom to lay down.
Ms. [VICTIM #1] advised Mr. Kinlaw then came back into the house and into the bedroom. Ms. [VICTIM #1] advised he then grabbed her by her throat by one hand, pressing her throat down into the bed, and proceeded to strangle her using 7-8 pressure (Scale 1-10) for a little less than a minute. Ms. [VICTIM #1] advised while she was being strangled, she could hardly breath, but did not lose consciousness, urinate, or defecate on herself. Ms. [VICTIM #1] advised officers knocked on the door, causing Mr. Kinlaw to let go of her. Ms. [VICTIM #1] advised Mr. Kinlaw then returned her cell phone and car keys, before exiting the home, where I made contact with him.
I checked Ms. [VICTIM #1] for injuries and noticed her neck area had redness on the front and both sides, and both her elbows were scraped. Ms. [VICTIM #1] also had complaints of severe back pain. Photos of Ms. [VICTIM #1]’s injuries were uploaded to Evidence.com.
Ms. [VICTIM #1] gave me permission to speak with her six year old daughter, [WITNESS #1]. [WITNESS #1] told me that she saw Mr. Kinlaw push Ms. [VICTIM #1] one time in the bedroom, twice outside, and one additional time into a wall inside the house.
CPL Wright arrived on scene and requested Domestic Violence Detectives.
SGT Dobson and SGT Simmons responded to the scene.
LT Lewis responded to the scene.
I was advised over the radio that Mr. Kinlaw had fled from officers on foot and was placed under arrest.
Ms. [VICTIM #1] and [WITNESS #1] were transported to Candler Hospital by EMS.
