On the above date and time, I was dispatched to [100 BLOCK] East Harris Street in reference to a loitering individual.
Upon arrival, I made contact with the reporting party, Mr. [WITNESS #1], who stated that through a window, he observed a black male sitting on his fire escape. Mr. [WITNESS #1] advised that he and his girlfriend could see the suspect from the chest up but were unaware of what he was doing with his lower body.
Mr. [WITNESS #1] further stated that his girlfriend alerted him to the incident, which he found suspicious. He then contacted police and, while waiting for officers to arrive, located a nearby security guard, Mr. [WITNESS #2], to assist in confronting the individual.
I then spoke with Mr. [WITNESS #2], who had the suspect detained in handcuffs upon my arrival. Mr. [WITNESS #2] stated that Mr. [WITNESS #1] had waved him down and reported a man loitering and peeking around on the fire escape. Mr. [WITNESS #2] entered through the back gate leading to the fire escape and observed the suspect standing with his pants lowered around his thighs and his p*nis exposed.
Mr. [WITNESS #2] stated that upon being confronted, the suspect attempted to cover himself with his hands. When questioned about his actions, the suspect replied that “the people inside said it was okay.” Mr. [WITNESS #2] then detained the suspect until police arrival.
The suspect was identified as Mr. Donta Johnson. Mr. Johnson was taken into police custody and charged with OCGA 16-7-21 (Criminal Trespass) and OCGA 16-6-8 (Public Indecency). He was transported to CCDC without further incident.
