On the above stated date and time, I responded to a disorderly conduct call at the listed location.
Upon arrival, I made contact with Jazmine Pinckney, who was standing on exterior stairs in the lane behind the address. Ms. Pinckney stated she was there to retrieve work clothes so she could go to work later that morning. I had responded to an earlier call involving Ms. Pinckney at this same location and had advised her to return during normal business hours and coordinate with the leasing office to retrieve any belongings.
While speaking with Ms. Pinckney, an unidentified female exited a downstairs apartment and stated Ms. Pinckney did not reside there and did not have any belongings inside. Immediately upon the female’s appearance, Ms. Pinckney began yelling and cursing loudly at her in the presence of officers and within view and hearing of the public. Ms. Pinckney further threatened to fight the other female.
Ms. Pinckney’s loud, profane language and threats of physical violence toward another individual in public view constituted Disorderly Conduct (OCGA 16-11-39).
I instructed the unidentified female to return inside the residence to prevent further escalation. The female initially continued yelling before complying. She refused officers entry to verify Ms. Pinckney’s claim of personal property.
Ms. Pinckney then stated she was not leaving the area and continued insisting she needed her work clothes. Ms. Pinckney could not produce anything showing she resided at the location and did not possess a key to enter. Ms. Pinckney admitted to consuming alcoholic beverages. I observed a strong odor of alcoholic beverage emitting from her breath and person, loud and profane speech, and belligerent behavior. Ms. Pinckney was in public view and causing a disturbance, meeting the elements of Public Drunkenness (OCGA 16-11-41).
Ms. Pinckney was given multiple lawful commands and opportunities to leave the area. She refused and stated the only way she would leave was if officers arrested her. Ms. Pinckney further stated she would return and continue causing a disturbance if not arrested.
Due to Ms. Pinckney’s continued disorderly behavior, intoxicated condition, refusal to comply with lawful commands, and stated intent to continue the disturbance, she was placed under arrest. Ms. Pinckney was handcuffed, sized to fit, and double locked. She was searched incident to arrest and placed in the rear seat of my marked patrol vehicle.
After being lawfully arrested, Ms. Pinckney was asked to provide her name and date of birth for identification. Ms. Pinckney refused and stated she was “pleading the Fifth.” She continued to refuse to identify herself, hindering officers in the performance of their duties, constituting Obstruction of Law Enforcement (OCGA 16-10-24(a)).
Ms. Pinckney was transported to the Chatham County Detention Center and booked without incident.
