On (10/10/2025), Ofc. W. Fitzpatrick [64272] and I, Cpl. B. Wilber [65491] were operating as a two-officer unit with SPD’s Community Response Team (CRT) assigned to the Violent Crimes Task Force. Both officers were wearing police uniforms with badges displayed. The events described in this report occurred within the City of Savannah, within the jurisdiction of Chatham County, Georgia.

Around 2350hrs while on foot patrol in the downtown entertainment district, officers were dispatched to the report of a fight-in-progress in front of the Eclipse Bar located at 127 W. Congress St.

WILLFUL OBSTRUCTION – FLEEING

As CRT officers approached the bar, a hispanic male (later identified as Juan Moctezuma) saw officers and immediately began sprinting Southbound on Barnard St. from W. Congress St. Officers chased Juan, giving verbal commands for him to stop. Officers caught Juan near the intersection of Barnard St. and W. Broughton St, one street block from the incident location. Juan resisted officers attempts to place him into handcuffs, pulling his hands toward his chest and trying to pull away from officers to escape.

A second man who was walking with Juan before he fled from officers was identified as Gabriel Adame. Upon review of surveillance camera footage, Gabriel was identified as a suspect in this case. He was detained in handcuffs without incident.

DISORDERLY CONDUCT

During this interaction, Juan was screaming insults and profanity at officers, causing visible disturbance in several nearby citizens who stopped on W. Broughton St. and began observing officers attempting to detain Juan. While in close proximity to officers, Juan’s body was emanating a strong odor of an alcoholic beverage.

FOOTAGE DESCRIPTION

CRT officers and Sgt. W. Johnson reviewed nearby surveillance cameras of the incident and obtained footage. In this footage, Juan and Gabriel can be seen standing outside of Eclipse arguing with the victim, identified as [VICTIM #1]. Juan took a step toward [VICTIM #1], leaving very little distance between the two men. [VICTIM #1] proceeds to push Juan in the chest with both hands, forcing him to take a step backwards. At this time, Gabriel (who was standing next to Juan) punches [VICTIM #1] in the left side of his face with his right hand. Juan immediately grabs [VICTIM #1] around the waist, wresting him onto the ground.

While [VICTIM #1] is on his hands and knees trying to stand back onto his feet, Juan punched [VICTIM #1] two more times in his face using his right hand while holding [VICTIM #1] by the hair with his left hand. Almost immediately as Juan delivers the second punch, Gabriel delivers another punch to the left side of [VICTIM #1]’s face, causing him to fully collapse face-first onto the sidewalk. In the video, [VICTIM #1]’s body goes limp, indicating that he lost conciousness. Gabriel then pulls [VICTIM #1] up by the top of his hoodie and punches [VICTIM #1] three additional times on the back of his head.

Juan proceeds to walk over [VICTIM #1] (from feet to head) and stomps on the back of [VICTIM #1]’s head using the heel of his right foot. Gabriel and Juan the walk Westbound on Congress while [VICTIM #1] remained lying unconcious on the sidewalk.

INVESTIGATION

Gabriel and Juan were read their Miranda Rights (verbatim) from a printed card. Juan refused to make any statements, but Gabriel agreed to speak with officers without legal counsel present.

Gabriel told officers that [VICTIM #1] had attacked Juan’s girlfriend prior to the fight between the men. He could not recall how many times he struck [VICTIM #1].

Both Gabriel and [VICTIM #1] had bruising to their knuckles.

[VICTIM #1] sustained serious bodily injury, including loss of conciousness, having two teeth completely knocked out of his mouth, and a large gash to his left temple, which was bleeding. [VICTIM #1] told officers that he wishes to prosecute both Gabriel and Juan.

CHARGES
Gabriel was transported to CCDC and booked for the following charges:

[O.C.G.A 16-11-39] – Disorderly Conduct
[O.C.G.A 16-11-41] – Public Drunkeness

Juan was transported to CCDC and booked for the following charges:

[O.C.G.A 16-11-39] – Disorderly Conduct
[O.C.G.A 16-11-41] – Public Drunkeness
[O.C.G.A 16-10-24(A)] – Willful Obstruction

DISPOSITION
