On 12/14/2025 at approximately 0240 hours, I was assigned as a SWAT officer conducting visibility patrol in the City Market area. This assignment was due to violent crimes that have occured in the area, including shootings, robberies, and fights. I was wearing my SWAT-issued uniform and equipment, with my badge clearly visible and my ballistic vest displaying large police insignia.

While assisting other officers with a report of a person with a gun who fled a subject stop at Whitaker Street and St. Julian Street, I observed a physical altercation occurring in front of Kay’s Pizza at the intersection of Whitaker Street and West Congress Street. I observed multiple individuals throwing closed-fist punches at one another while yelling. Due to the active and violent nature of the disturbance, I immediately moved to the location to intervene.

Upon arriving on scene, I observed a male and a female, later identified as Mr. Frye and Ms. Dinks, aggressively walking toward several other females who were standing in line waiting for pizza. Mr. Frye and Ms. Dinks were yelling at another group that was maintaining more than an arm’s-length distance from them. Without warning, Ms. Dinks grabbed one of the females by the hair and began striking her repeatedly with closed fists directly beside me. At the same time, Mr. Frye began pushing several of the females and attempted to join the physical altercation.

Given the severity of the offense and the immediate risk of injury to those involved, I attempted to physically separate the fighting individuals. Due to the crowded sidewalk and being pushed by others involved in the disturbance, I lost my balance and fell to the ground.

While on the ground, Ms. Dinks and the other female continued fighting directly on top of me, throwing closed-fist strikes. I attempted multiple times to stand up but was unable to do so due to being pinned and restricted in movement. While in this vulnerable position, I felt sharp pain in both of my hands as multiple individuals stepped on me. At this point, I was unable to disengage or retreat, and the ongoing assault posed an immediate threat to my safety as well as the safety of others in the area.

I attempted to push Ms. Dinks away from me using empty-hand techniques, but these efforts were ineffective, and she continued actively fighting on top of me. Due to her continued violent behavior, my compromised position on the ground, and the inability to gain control through lesser means, I escalated my use of force.

I activated my issued Taser and deployed it at Ms. Dinks’ torso. The deployment was ineffective due to the extremely close distance and the probes failing to penetrate her jeans. I then transitioned to a drive-stun application within the same activation cycle while giving loud verbal commands for her to get on the ground. The drive-stun was effective in gaining compliance and allowed officers to take Ms. Dinks into custody.

Mr. Frye was also forcefully removed from the fight by responding officers and placed in handcuffs.

After the scene was secured, I assessed myself for injuries and observed that my left thumb was swollen and I was unable to move it. I notified supervisors on scene of both the Taser deployment and my injury. Use-of-force protocol was followed.

Ms. Dinks and Mr. Frye were both charged with Disorderly Conduct. Due to multiple fights occurring in the immediate area and limited staffing available to regain control, interviewing officers prioritized restoring public order.

Ms. Dinks was transported to the hospital and medically cleared prior to being booked into CCDC. Mr. Frye was also booked into CCDC. I later went to the hospital, where a physician determined that I had suffered a sprained left thumb.
