On 09/06/2026 at approximately 1326 hours, I was dispatched in reference to a Generic law call. The notes from dispatch stated two cooks were arguing in the kitchen of a restaurant, and 1 of the males had a weapon.

When I and Officer Carter arrived on scene we spoke to all the subjects involved. The suspect, Mr. Tysheem Thomas, was brought over to my patrol vehicle, and a firearm was taken from a holster seated inside his pants at his waistline. A full magazine and a bullet inside the chamber were retrieved as well. Mr. Thomas stated that he and another cook were having an argument because he was being accused of being complacent on the job while the restaurant was busy. He went on to say he was being taunted by the cook and the other staff. He then stated that once outside, tomatoes were thrown at him. He stated that was assault and he, “wasn’t going to put up with their threats.” He then stated he placed his hand over where his gun was at his waistline but never pulled it out or pointed it in anyone’s direction.

I then spoke with the owner of the restaurant, Ms. [WITNESS #1], who had recorded video of the incident from inside her kitchen. Ms. [WITNESS #1] put herself between Mr. Thomas and the other cook and tried to push him out the back exit door to deescalate the two. Once she was outside with Mr. Thomas, she closed the door not allowing the other cook, Mr. [VICTIM #1], to come outside. A few moments later, both Ms. [WITNESS #1] and Mr. Thomas come back inside the kitchen and Mr. Thomas begins to collect his things in order to leave. Another argument ensues between the two, this time Mr. Thomas is told multiple times to leave the building.

Again Ms. [WITNESS #1] steps in between the two cooks and as Mr. Thomas is outside, he turns around to yet again confront Mr. [VICTIM #1]. Mr. [VICTIM #1] then takes two tomatoes and throws them over Ms. [WITNESS #1]’s head intending to hit Mr. Thomas with them. Mr. Thomas then reached at his waistband under his shirt, retrieves his fully loaded firearm, and brings it out with his arm cocked at a 90-degree angle. He then takes a couple steps back, squares his hips with his shoulders and raises the weapon to shoulder height and points the barrel of the gun towards Mr. [VICTIM #1] before coming to a rested position with the weapon at his side. While he is still holding the pistol in his hand, he then steps towards the door and tries rushing in with his hand on the door. Ms. [WITNESS #1] is able to keep him outside and shuts the door, while Mr. [VICTIM #1] is seen retreating to the other end of the kitchen attempting to get to a safe location.

Based on my training and experience, the stance that Mr. Thomas took was not a defensive position, but that of a firing stance. The only thing Mr. Thomas would have had to do after squaring his hips with his shoulders, taking steps back, widening his stance and bringing the gun to shoulder height, would have been to punch out with both arms extended and line up his front and rear sight in order to fire at Mr. [VICTIM #1] and Ms. [WITNESS #1].

Ms. [WITNESS #1] went on to say that after failed attempts to come in thru the back door after being told to leave, Mr. Thomas went around to the front of the building to try and get to the kitchen. Believing this may be an Aggravated Assault, I called for a supervisor. Sergeant McConaughy arrived on scene and assisted with the investigation.

I then spoke with the victim, Mr. [VICTIM #1]. He stated that he and Mr. Thomas had been arguing about his performance at work while the restaurant was busy. After not listening to directions from Mr. [VICTIM #1] over a period of time, he then told Mr. Thomas to leave the kitchen for the day. He stated that when Ms. [WITNESS #1] got in between them due to the argument getting loud and guests being able to hear, he felt the need to protect Ms. [WITNESS #1] and felt Mr. Thomas was beginning to turn his aggression towards her. Mr. [VICTIM #1] admitted to throwing the tomatoes at Mr. Thomas, but when Mr. Thomas drew his firearm, Mr. [VICTIM #1] said he “felt in fear for my life. I thought he was going to try and kill me.”

Based on the fact that Mr. Thomas was asked several times to leave before things escalated, and the overreaction of reaching for a deadly weapon to fruit being thrown in his direction, I deemed Mr. Thomas to be the predominant aggressor in the altercation. Since Mr. [VICTIM #1] felt like Mr. Thomas’ action put him in fear for his life and a weapon was involved, I placed Mr. Thomas under arrest. He was charged with OCGA 16-5-21 Aggravated Assault. Since Mr. Thomas was instructed to leave multiple times by the store owner and refused; I charged him with OCGA 16-7-21 Criminal Trespass.

I created a case report number and shared with Ms. [WITNESS #1] how she could obtain a copy of the report. Officer Carter who was on scene, transported the firearm to the property room where she logged i in for safekeeping.

I then transported Mr. Thomas to Chatham County detention center (CCDC) where he was booked at turned over to their custody,
