On the above date and time, I, Deputy A. Garmany #14, along with Cpl. J. Wilks #04, responded to the above location in reference to a physical domestic dispute between a daughter and father. Upon arrival on scene, I made contact with the complainant/Victim, later identified as [VICTIM #1].
Mr. [VICTIM #1] stated that he and his daughter/suspect, later identified as Laura Payne Hanson, became involved in a verbal argument regarding cigarettes. Mr. [VICTIM #1] stated that during the argument, the suspect began “attacking” him and grabbed him by his right upper arm. I asked Mr. [VICTIM #1] to roll up his sleeve and show me where he had been grabbed. Mr. [VICTIM #1] had been holding his right arm since our arrival on scene. Upon observing the area, I noticed significant bruising to the victim’s right upper arm, which was consistent with being forcibly grabbed.
Mr. [VICTIM #1] stated he was attempting to calm the suspect down and get her to go outside, but she continued to “attack” him. Mr. [VICTIM #1] also stated that the suspect is much bigger and stronger than he is and that he cannot handle her when she acts this way. I asked Mr. [VICTIM #1] if he would like EMS to respond and evaluate him, and he declined medical treatment at that time.
I then went to the location behind my patrol vehicle where Cpl. Wilks was speaking with the suspect. Cpl. Wilks advised that the suspect requested EMS in reference to a scratch on her arm and because she felt she may have been having an allergic reaction. Cpl. Wilks requested EMS through Chattooga County E-911.
I asked the suspect what had occurred that morning which prompted law enforcement response. The suspect stated that she did not know why we had been called and claimed that after she arrived home, the victim began yelling at her for no reason. The suspect then began speaking about unrelated topics involving her medication and items she claimed to have found inside the residence. While speaking with the suspect, I observed that she was extremely fidgety, unable to stand still, and repeatedly complained that her throat felt dry or as if it was “closing up.” The suspect continuously asked for something to drink.
Floyd EMS arrived on scene shortly thereafter. Due to the victim being seventy-six years old and elderly, myself and Cpl. Wilks requested EMS personnel also evaluate Mr. [VICTIM #1] while we remained with the suspect. EMS personnel later advised that the victim was experiencing possible medical issues but refused transport to the hospital. EMS personnel requested that law enforcement witness the refusal form, which was completed on scene.
Afterward, EMS personnel checked the suspect’s vital signs due to her request for medical evaluation. EMS personnel advised that the suspect appeared to be okay and was not suffering from any life-threatening medical emergency at that time.
Based on the statements provided, physical evidence observed on the victim, and the totality of the circumstances, I advised the suspect that she was under arrest. I instructed the suspect to place her hands behind her back, at which time I handcuffed her, checked the cuffs for proper fit, and double locked them. The suspect was then placed into the rear of my patrol vehicle and transported to the Chattooga County Detention Center without incident.
