On Thursday, October 16, 2025, at 9:53 p.m., I was dispatched to a person drunk call at 14 Mill Street (Marathon gas station). The caller told dispatch there was a male in a red Chevrolet pickup truck who was drunk and trying to leave. The caller attempted to get the male to stay as he was trying to leave. The caller said the vehicle left the gas station and took a right onto Reinhardt College Parkway.

I was driving northbound on Waleska Road at the intersection of Reinhardt College Parkway. I saw a red 2014 Chevrolet Silverado (GA tag: [REDACTED]). The truck was in the left turn lane to turn onto the Reinhardt College Parkway connector. The truck entered the intersection. I activated my patrol car’s emergency lights and siren. The truck went to the right, then turned back left, turning onto the Reinhardt College Parkway Connector.

As the truck turned onto the connector, it drove over a concrete island, striking a crosswalk sign. The truck continued by driving on Reinhardt College Parkway and drove into the grass median. The truck continued driving in the median, then returned to the roadway. The truck drove to the right turn lane, then into the grass on the right side of the road. The truck continued driving in the grass at a slow rate of speed before coming to a stop on Reinhardt College Parkway just before River Ridge Drive.

I exited my patrol car and approached the truck. As I approached the truck, I smelled the strong odor of an alcoholic beverage coming from the vehicle. I asked the driver, Andres Matias Mateo, for his driver’s license, which he provided me.

I asked Andres to step out of his truck and back towards my patrol car. As Andres exited his truck, he was unsteady on his feet and unable to maintain his balance. Once in front of my patrol car, I asked Andres if I could check his eyes, and he said yes.

I asked Andres to stand with his feet together and arms down by his side. Andres fell back onto my patrol car. I told Andres to lean up against my patrol car. I performed the horizontal gaze nystagmus evaluation. I observed six out of six clues. Andres had the lack of smooth pursuit in both his right and left eyes. Andres had distinct and sustained nystagmus at maximum deviation in both his right and left eyes. Andres had the onset of nystagmus prior to 45 degrees in both his right and left eyes. Andres’s eyes were bloodshot.

I asked Andres how much alcohol he had to drink, and he said he had not had anything to drink. As I spoke with Andres, I continued smelling the strong odor of an alcoholic beverage coming from his person.

I told Andres he was under arrest for driving under the influence, and to put his hands behind his back. I put Andres in handcuffs, checking for proper fit, and double-locking them. I searched Andres, placed him in the rear seat of my patrol car, and secured the seat belt. I read Andres the Georgia Implied Consent Notice For Suspects Age 21 Or Over, asking if he would submit to the state-administered chemical test of his blood, and he said no.

I searched Andres’s vehicle. In the bed of the truck, in a blue cooler, was one full Modelo beer bottle. In the back seat of the truck was a paper cup with a liquid inside. The liquid smelled of an alcoholic beverage.

Earlier in the night, dispatch put out a bolo for a hit and run out of the Canton Police Department. The bolo was for a red pickup with heavy front-end damage. I asked dispatch to notify the Canton Police Department, as I believed this was the vehicle they were looking for. Officer Logan, with the Canton Police Department, arrived and confirmed it was the hit-and-run vehicle.

I asked dispatch to have a tow truck en route to tow the vehicle. Dispatch advised Mauldin’s towing would be en route. Sergeant Smith completed an inventory (impound sheet #76551 and stayed with the vehicle until the tow truck arrived.

I transported Andres to the Cherokee County Adult Detention Center, where he was turned over to jail staff. Once jail staff removed Andres from my patrol car, I searched the rear seat for contraband, finding none. I secured a search warrant, signed by Judge Sullenger, for two vials of Andre’s blood.

Deputy Miller, a law enforcement-certified phlebotomist, conducted the blood draw, drawing two vials of Andres’s blood. The blood vials were sealed within a GBI Blood Alcohol/ Toxicology Kit and placed into Waleska evidence locker #1. I issued Andres citations for driving under the influence (S-020660), weaving over the roadway (S-020661), striking fixed object (S-020662), and open container alcohol in vehicle (S-020663).
