[NARRATIVE #1 on March 12, 2026]

On March 12, 2026, at approximately 1521 hours, I responded to the RaceTrac located at 7984 Cumming Highway in reference to a hit and run. Dispatch notified us that a white Kia Soul was involved in a hit-and-run accident with a black Acura (GA Tag: [REDACTED]), and the female driver of the black Acura refused to stop and sped away after the driver of the white Kia Soul flashed his light at her.

Upon arrival, I met with [VICTIM #1], driver of a white Kia Soul (GA Tag: [REDACTED]). I observed a white Kia Soul with minor damage on the Driver’s side near the front.

[VICTIM #1] stated he was traveling eastbound on Cumming Highway toward Union Hill Road. [VICTIM #1] was traveling in the right lane, and a black Acura was traveling in the left lane (the merging lane). [VICTIM #1] then stated that a black Acura merged into his lane, striking his driver’s side with her passenger’s side.

After the collision, a black Acura got in front of [VICTIM #1], did not stop, and continued eastbound on Cumming Highway. [VICTIM #1] flashed his lights to get her attention, but she did not stop. Hoping for black Acura to stop, [VICTIM #1] followed the suspect’s vehicle from Union Hill Road to the intersection of Cumming Highway and East Cherokee which was approximately 4 miles and she passed plenty safe spot to pull over.

[VICTIM #1] stated the black Acura continued eastbound on Cumming Highway toward Forsyth County, then pulled over to RaceTrac to dial 9-1-1. [VICTIM #1] stated the driver of the black Acura was a female driver with long hair. [VICTIM #1] showed me a video of the black Acura traveling eastbound on Cumming Highway ahead of him after the accident.

I ran the tag for the black Acura (GA Tag: [REDACTED]) through GCIC/NCIC, and the registered owner was returned as Ann De Luca with an address of [300 BLOCK] India Lane, Canton, GA. I requested Canton PD to check the residence for the vehicle. Shortly after, I spoke to Officer King from Canton PD via telephone. Officer King told me that he made contact with the homeowner, [WITNESS #1].

According to Officer King, [WITNESS #1] was contacted by his fiancée, Ann De Luca, today, who said she was involved in an accident on the way to her meeting. Officer King also confirmed that Ann was driving a black Acura. [WITNESS #1] stated that Ann had pulled over and sent him a picture of the damage. [WITNESS #1] then stated that only Ann and he live at this address.

Later, Corporal Reilly spoke to [WITNESS #1] via telephone, and [WITNESS #1] gave the same statement he had given to Officer King. We asked [WITNESS #1] to send a photo of the damage to her vehicle. Later, I reviewed the photo and observed minor damage on the passenger’s side with a white paint mark. [WITNESS #1] also stated that he might be able to pull the video of the accident from the vehicle and will send it to us once it’s ready. We attempted multiple times to seak with Ann via telephone, but she did not answer.

After gathering information, I determined Ann was the driver of the black Acura. Ann had violated OCGA 40-6-270 Hit and Run because she failed to stop after she was involved in an accident resulting in damage to [VICTIM #1]’s Kia Soul. Ann failed to provide her name, address, and the vehicle registration number of the vehicle she was driving, and left the scene of the accident, knowing she was involved.

An arrest warrant (Warrant #CE0144446) was reviewed and signed the Cherokee County Magistrate Court Judge K. Ziegler on today’s date at 1904 hours.

I documented the damage to [VICTIM #1]’s vehicle by taking photographs which were submitted in an Axon link.

On March 13, 2026, at approximately 0940 hours, Ann De Luca turned herself in at the Cherokee County Adult Detention Center, and Deputy Earley executed an arrest warrant.

[NARRATIVE #3 on March 13, 2026]

On 03/13/2026 I went to the address of [300 BLOCK] India Lane for a wanted person.

Upon arrival, I knocked on the door and identified my agency. The wanted person, Ann De Luca answered the door and walked onto the front porch. I told Ann she was under arrest, then asked her to put her hands behind her back. Ann complied with my request. I placed handcuffs on Ann, checked for proper fit, and ensured the hand cuffs were double locked.

Ann explained she had already spoken with her attorney about making arrangements with my chain of command. Sgt Martin verified Ann’s claim. I took Ann out of hand cuffs and told her to follow her attorneys advice.

On Friday March 13th, 2026 I Deputy FitzPatrick was assigned to the lobby at the Cherokee county adult detention center. At approximately 0940 Ms. De Luca, Ann. entered the lobby to turn herself in on a hit and run. Deputy Earley secured the warrant and took Ms. De Luca downstairs to intake to start the book in process.
