Officer’s Narrative:

On March 26, 2025, I was dispatched to [6300 BLOCK] Bells Ferry Road, Lot [REDACTED] in reference to a domestic dispute. En route dispatch advised the following: The caller and the female were yelling at each other, all parties sounded under the influence of an alcoholic beverage to the dispatcher. The caller stated she did not want to be assaulted in her own home. The caller told the call taker the Sheriff’s Office was just there. The caller was being aggressive with the female in the background and advised the female touched her, the female stated that she did not.

I and the other responding deputies are previously familiar with all of the parties involved. Oak Grove deputies responded to this address earlier in the night for a fight in progress (SO Case #: SO25-004251) where we were not able to establish probable cause to make an arrest. Deputies had mediated and separated the parties advising all of them to go home and go to bed.

On my arrival, Deputy Lorimer went and spoke with [VICTIM #1] and [WITNESS #1] [VICTIM #1] stated Bari came over to the residence wanting to jump on her (engage in a physical altercation). [WITNESS #1] immediately stated Bari had come to the residence to apologize.

I went to Lot [REDACTED], and spoke with Bari Hicks, who was slurring her speech, and had the strong odor of an alcoholic beverage coming from her person; she reported the following: [VICTIM #1] asked Bari to come to over to her house so that she could talk with Bari. [VICTIM #1] reportedly “went psycho” and Bari went back home. [VICTIM #1] reportedly started to call Bari a “piece of sh*t”, and a “wh*re”, and then reportedly accused Bari of trying to “get with” [WITNESS #1]. Bari denied engaging in a physical altercation with [VICTIM #1].

While I was conducting my investigation I ordered Bari to walk down the stairs to wait with Sgt. Fulenwider and Deputy Seibel so that she would not retreat into the residence. Bari initially refused stating that she had her kids inside of the residence. I escorted Bari down the stairs and then went back to Lot [REDACTED].

Once back at Lot [REDACTED], I spoke with Deputy Lorimer, who reported the following: Bari came over and was upset the Sheriff’s Office was called, Bari then slapped [VICTIM #1] and left.

I returned back to Bari and I could hear her yelling at Sgt. Fulenwider from a good distance away, she yelled, “I AM NOT THAT GOD DAMN DRUNK!”. I told Bari to stop yelling, and she yelled, “NO BECAUSE THIS IS BULLS*IT!” and Sgt. Fulenwider advised she was under arrest, Bari started to yell, “[REDACTED] THEY’RE ABUSING ME!” As I and Sgt. Fulenwider attempted to effect a custodial arrest, Bari started to walk away and I grabbed her right arm and she attempted to pull away from me multiple times. While handcuffing Bari, Sgt. Fulenwider told Bari not to spit at him. I handcuffed Bari with her hands behind her back, the handcuffs were checked for proper fit and double-locked.

Sgt. Fulenwider escorted Bari to Deputy Seibel’s patrol car, while Sgt. Fulenwider escorted Bari to the patrol car I could hear him loudly order Bari to stop grabbing him. Sgt. Fulenwider placed Bari in the patrol car, as he did this I observed Bari bring her legs up to her chest and kick at Sgt. Fulenwider. As she did this, I pulled Bari across the prisoner cage towards the driver’s side to protect Sgt. Fulenwider from further kicks. As Bari was combative we were not able to secure her in the prisoner cage with a seat belt, for fear that she would attempt to injure another deputy.

Deputy Seibel and I transported Bari to the Cherokee ADC, once at the Cherokee Jail, Bari and her property were transferred to the custody of the Cherokee County Jail Staff. Bari was charged with the following:

  1. O.C.G.A. 16-11-39: Disorderly Conduct
    a. For engaging in loud and boisterous behavior yelling in a residential neighborhood at a time and manner which would constitute an immediate breech of the peace, while under the influence of an alcoholic beverage.
  2. O.C.G.A. 16-5-23(E): Simple Battery on a Law Enforcement Officer
    a. For grabbing Sgt. Fulenwider while he was escorting Bari to the patrol car. As well as kicking at Sgt. Fulenwider while in the prisoner cage of Deputy Seibel’s patrol vehicle.
  3. O.C.G.A. 16-10-24(a)(M): Obstruction
    a. For resisting deputies from taking Bari into custody after she was informed she was under arrest.
  4. O.C.G.A. 16-5-23: Simple Battery
    a. For slapping [VICTIM #1] in the residence located at Lot [REDACTED].

Warrants will be applied for Bari. As Bari stated her children ([JUVENILE #1] and [JUVENILE #2]) were home alone, Sgt. Fulenwider and Deputy Lorimer took them into protective custody and transported them to the Oak Grove Precinct. Once there DFCS was contacted and on [REDACTED]’s (Social Service Specialist) arrival, he took custody of the juveniles and attempted to find placement for them. A DFCS referral was completed.
