[NARRATIVE #1 on August 2, 2022]

On August 2, 2022, I responded to [6000 BLOCK] Little Ridge Drive in reference to a domestic dispute. Dispatch advised the complainant was a female and was screaming at her husband on an open line.

As I pulled up, I observed a blue SUV quickly pass me and drive into the driveway. The female driver, later identified as [VICTIM #1], exited the SUV. I asked her what was going on and she started to yell that her mom is crazy and tried attacking her dad so she told her dad to leave. I asked if her father was coming back because we needed to speak with him. [VICTIM #1] proceeded to scream and cuss at me. What she was saying did not make any sense at the time and she appeared to be mad at me for being there.

Deputy Oler and Sergeant Jordan arrived on scene. Deputy Oler and I went to the front door while Sergeant Jordan spoke with [VICTIM #1]. We knocked on the front door and rang the doorbell. We were standing on the porch in front of a double-paned window with the blinds completely open. We could clearly see into the kitchen and to the right where the living room was. Cheri Orr, [VICTIM #1]’s mother, picked up a hammer off the table and came walking quickly towards the window screaming and cussing at me to “get the fu*k off her porch”, wielding the hammer back like she was either going to throw it or strike me with it. She continued walking to the front door through the living room.

I made sure Deputy Oler was aware she was coming to the door with a hammer up. He acknowledged that he saw it too and we unholstered our county-issued firearms, keeping them down at our side. We shifted positions to gain cover from the front door in case she were to go forward with an attack. Once she opened the door and saw Deputy Oler standing at the door, she put down the hammer. We reholstered our weapons after we determined there was no longer a weapon in hand. She continued to scream at me and accused me of “ripping off her shoulder”. I then remembered her from a prior arrest where I arrested her for shoplifting and she was compliant until the point where I applied handcuffs. During that incident, she also cussed, screamed, and refused to walk to the patrol car.

She began to somewhat calm down with Deputy Oler so I stepped back over to Sergeant Jordan and [VICTIM #1]. [VICTIM #1] was apologetic and explained the following: Her mother has mental health issues and often calls 911 to get her dad in trouble. She thought I was there to arrest her dad based on lies her mom told 911. I reassured her we were just trying to figure out what was going on. Sergeant Jordan went over to assist Deputy Oler.

I explained to [VICTIM #1] we needed to speak with her dad and asked for him to come back to the house. She called him and he agreed to return to make a statement. While waiting for [VICTIM #2] to return, I continued to interview [VICTIM #1]. She stated the following: She lives down the road but comes to visit her parents often. She came over to hang out with her dad when her mom came home. Her mom asked for a tent and was trying to collect her items. She had brought her boyfriend, [REDACTED], to the house while collecting the items. She has been having an affair with [REDACTED] and gets mad when the family makes comments of disapproval. Her dad asked her to get [REDACTED] off the property, then her mom “lost it” and started throwing items in the house. Her mom then threw a cardboard container with a cheeseburger inside it at her and it struck her, with the contents then falling to the floor. Cheri then got “in his face”, referring to her dad. Cheri then made statements that she would “fu*king hit him” and kept a clenched fist raised like she was going to punch him. She and her dad left the home but she turned around when she saw Law Enforcement coming to the house.

As I finished my interview with [VICTIM #1], [VICTIM #2] arrived. He stated the following: He has been married to Cheri for a long time. She has mental health issues and a history of substance abuse. She was friends with [REDACTED], a homeless man, and allowed him to live in an RV in the driveway of their home. She began to have an affair with [REDACTED] and got mad at him when he wanted [REDACTED] to leave the property. She continued the affair although [REDACTED] moved somewhere else. Today, she came home to get a tent. He noticed [REDACTED] was outside and demanded she have him leave the property. Cheri then became enraged and threw the food container at [VICTIM #1], then lunged at him holding a large glass candle jar as if she were going to hit him with it. She would then repeatedly get in his face and raise her fists saying she was going to “fu*king hit him”. He then left with [VICTIM #1] and returned once [VICTIM #1] called him saying we needed a statement.

I notified Deputy Oler of my charges: Simple Assault (FVA) for placing [VICTIM #2] in reasonable fear of receiving bodily injury, Simple Battery (FVA) for Striking [VICTIM #1] with a food container with contents, and Obstruction (Misdemeanor) for coming to the front door wielding a hammer, a deadly weapon while knowing we were Law Enforcement and there to investigate a 911 call she made. Due to prior history, Deputy Oler and Sergeant Jordan arrested Cheri while I stayed with [VICTIM #2] and [VICTIM #1].

While speaking with [VICTIM #2] and [VICTIM #1], I could hear Cheri screaming as Deputy Oler and Sergeant Jordan asked her to walk to the car. When she was getting into the back of Deputy Oler’s patrol car, she screamed “You’ll pay for this, [VICTIM #1]”. [VICTIM #1] was visibly upset and I reassured her and asked her to ignore Cheri the best she could. [VICTIM #1] and [VICTIM #2] said this is a common issue and they try not to call 911 because they think this is a mental health issue, although this has been going on for a long time. I gave [VICTIM #2] and [VICTIM #1] case cards and VINE cards. I passed along information for the Cherokee Family Violence Center and explained how to apply for a Temporary Protection Order.

Before I left, [VICTIM #2] pulled up the security footage from the incident. There was an outdoor ring camera and camera with audio inside the living room. Pulling it up on his phone created a lot of static and lagging, however, the video fully corroborated [VICTIM #1] and [VICTIM #2]’s statement. I asked him to send me a video of the link if he could, however, I have not received it.

[NARRATIVE #2 on August 2, 2022]

On 08/02/2022 at approximately 2001 hours, I responded to [6000 BLOCK] Little Ridge Road in reference to a domestic dispute.

Deputy Gergans and I attempted to contact the caller, later identified as Cheri Orr, at the front door of the residence. After knocking on the door multiple times, Cheri came to the front door. I saw her through a window at the front of the residence, she was walking towards the door with a hammer in her hand, raised near her head. She was yelling loudly while approaching the door. She disappeared, behind a wall, between the window and the door for several seconds. I unholstered my county-issued firearm, keeping it by my side. I heard the door unlock. Cheri opened the door, she appeared to be unarmed, and began yelling at Deputy Gergans to get off of her property. I returned my firearm to its holster.

She continued to yell referencing a previous incident involving Deputy Gergans. Cheri slammed the door and continued to yell. Deputy Gergans walked away and returned to the driveway. I asked Cheri to speak to me without Deputy Gergans present by calling out to her loudly through the door. She opened the door again and stepped out onto the porch. Cheri continued to yell while speaking to me and was very animated with her body language. She yelled about being arrested by Deputy Gergans at Walmart for shoplifting. She tried to describe the incident to me and how Deputy Gergans arrested her. She grabbed at my arm in an attempt to display how Deputy Gergans placed her in handcuffs. I stepped away from her, pulling my arm back, and ordered her to stop trying to touch me. She complied with my request. She appeared to be agitated due to her behavior and constant yelling.

She stated the following: An argument occurred between her and her husband, [VICTIM #2], were in a verbal argument over her friend, [REDACTED], being at their residence. She invited [REDACTED] over to their residence to fix her car. [VICTIM #2] did not want him there. No physical altercations occurred during the incident. She admitted to throwing a McDonald’s cheeseburger at the door but said she did not throw it toward anyone. I saw a bun and some toppings lying on the floor near the door. [VICTIM #2] arrived on the scene while I was speaking to Cheri. She offered to stay in the RV for the remainder of the evening to separate herself from him. I relocated to speak to Deputy Gergans, who was speaking to [VICTIM #2] in the driveway.

Deputy Gergans informed me she had probable cause to arrest Cheri for Simple Battery FVA and Simple Assault FVA. She requested I place Cheri under arrest and transport her to the Adult Detention Center for her to attempt to reduce the chance of any further altercations between her and Cheri.

I relocated to the front porch and noticed Cheri was inside the residence near the front door. She had a trash bag in hand and was cleaning up the area. Cheri was notified she was under arrest. She told me she was not going back to jail and retreated into a back room, she attempted to close the door behind her. She began yelling about not wanting to go to jail. I stopped her from closing the door and followed her into the room. I grabbed her left arm to secure her in handcuffs. She grabbed onto a dresser with her right arm and tried to pull away from me. Sergeant Jordan took her arm from me as I grabbed her left arm and pulled it away from the dresser. She went limp and sat down on the ground.

We guided her down by continuing to hold her arms so she did not harm herself. She then started screaming incoherently at the top of her lungs. She began kicking her legs and attempted to stand up. We kept her seated on the ground and secured her in handcuffs. Sergeant Jordan and I assisted her to her feet and escorted her to my patrol car, which was searched prior to the beginning of my shift for contraband. Cheri continued yelling and cursing about the incident, not wanting to go to jail, and demanded we check the Ring cameras in and around the residence.

I transported Cheri to the ADC. While en route to the ADC, Cheri continued yelling in the back seat of my patrol car. She made spontaneous utterances about throwing a cheeseburger at her daughter, [VICTIM #1] when she was walking out the front door earlier in the evening. ADC Deputies took custody of Cheri upon our arrival. All necessary paperwork was filled out. I searched the back seat of my patrol car, finding no contraband. I returned to service.
