CHEROKEE COUNTY, Ga. – A Cherokee County man was convicted of rape after the victim recorded him admitting to the crime, prosecutors announced Wednesday.
Nicholas J. Mittenmeyer, 45, of Woodstock, was found guilty on March 21 of rape, family violence-aggravated assault, and false imprisonment following a five-day trial, according to the Blue Ridge Judicial Circuit District Attorney’s Office.
The Cherokee County Sheriff’s Office launched an investigation in June 2023 after a woman reported being raped at a Woodstock home.
Prosecutors said Mittenmeyer and the victim had previously been in a relationship, which ended two years before the assault, though they remained in contact. The woman told authorities Mittenmeyer pressured her to have sex, and when she refused, he forced himself on her.
Fearing she wouldn’t be believed due to their past relationship, the victim did not immediately report the assault, prosecutors said. However, days later, she confronted Mittenmeyer and secretly recorded their conversation, during which he admitted to the crime and apologized.
During the trial, 12 witnesses testified, including the victim. Prosecutors presented 26 pieces of evidence, including photographs of injuries from two prior incidents and the audio recording of Mittenmeyer’s confession.
A judge will schedule sentencing at a later date.
