I was in the area of Main St and Golf Course Rd, other units advised the hit and run suspect vehicle was heading into down town. Shortly after I observed the black Nissan Altama pass me. I turned arround and activated my emergency equipment, the vehicle turned right onto Golf Course Rd.
I advised dispatch I spotted the vehicle and attempted to catch up with the vehicle, I advised that it appeared that the vehicle might Flee. I turned right onto Longview St. Once I topped the hill the Nissan was stopped at the bottom of the hill.
The left rear passenger (Identified as Dillon, Diamante) rolled his window down and put his hands out. I asked who was driving and Dillon stated he was not. I asked Dillon to step out of the vehicle and detained him while we investigated the Hit and Run.
Dillon repeatedly stated he wasn’t driving and did not have a license. The drivers seat was unoccupied. I ensured Dillon’s handcuffs were placed on properly and double locked to prevent them from becoming too tight, I searched Dillon for any weapons/ contraband and secured him in the rear of my patrol vehicle.
I contacted Ofc. Bacon who was on scene with the other driver involved and asked if they could provide any descriptions of the driver. Both occupants were described as young back males, however the passenger was described to have dreads. This information assisted in figuring out who was driving. Other units arrived on scene to assist and spoke with the passenger (Identified as [REDACTED]). [REDACTED] immediately stated that he knew he should have drove upon exiting the vehicle.
During the course of the investigation Dillon continued to be argumentative and upset about being placed under arrest, he even stated he was under arrest because he was black. In conclusion, I found that Dillon was indeed the driver of the vehicle during the time of the accident.
I cited Dillon for Hit and Run (40-6-270)(26000311) and Driving While License Suspended (40-5-121(a))(26000312). I transported Dillon to Cherokee County Jail and completed the booking process. Once completed I checked the rear of my patrol vehicle to ensure no weapons or contraband were left behind.
