On May 8, 2022, at approximately 0015 hours. I was patrolling the area of Ball Ground Hwy near E Cherokee Dr in Cherokee County. I was driving North on Ball Ground Hwy and came to a stop at the three-way intersection. As I came to a stop, I saw a silver sports car, which was driving South on Ball Ground Hwy, that was already stopped at the stop sign. The silver car made a left-turn onto E Cherokee Dr and began driving south. I made a right-hand turn onto E Cherokee Dr and began driving in the same direction.
After making the turn onto E Cherokee Dr, the silver car (GA tag [REDACTED]) accelerated rapidly and began driving at a high speed. Knowing this area of E Cherokee Dr has a 40 MPH speed limit, I activated my dash camera and began pacing the vehicle. I initially paced the silver car at speeds over 60 miles per hour. Having probable cause for a traffic stop, I decided to wait and stop the vehicle further south at the Waste Management facility where there is a turning lane. The reason for this was because this portion of E Cherokee Dr was not well-lit and had several tight turns which greatly limited visibility. There was also no shoulder, and the limited visibly made conducting a traffic stop at this location very dangerous.
The silver car continued to accelerate and was driving around these very tight turns at a very dangerous speed. At one point, I looked down at my speedometer, and my speed was greater than 80 MPH. While attempting to keep pace with the silver car, my vehicle began to lose rolling friction due to the dangerously-high speeds around several very sharp turns. It was at this moment that I determined the silver car was an immediate danger to other motorists, and I decided to stop the car prior to the Waste Management facility. I activated my emergency lights to stop the vehicle, and the silver car, now identified as a Mazda RX8, came to a stop near the intersection of E Cherokee Dr and Cokers Chapel Rd. I exited my patrol car and approached the driver’s side of the vehicle, where I made contact with the driver, Grayson Breaux, and the passenger, [WITNESS #1].
I asked Grayson why he was driving at such a dangerous speed, and he said it was because he did not realize I was law enforcement and thought he was being followed. I turned to the passenger and asked how old she was. [WITNESS #1] replied she was 17, and I instructed her to call her parents and have them come and pick her up. I instructed Grayson to step out of the car, and he complied. I brought him to the front of my patrol car where I conducted a non-intrusive search of his person for weapons. I then instructed him to remain at the front of my vehicle while I ran his license and vehicle through GCIC.
When ran though GCIC, Grayson’s license returned valid, and his vehicle returned with proper registration and insurance. By driving his vehicle at speeds approximately 40 MPH above the speed limit and in an area that was not lighted with very sharp turns, Grayson demonstrated reckless disregard for other persons or property. As a result, I placed him under arrest for reckless driving. I placed handcuffs on his wrists, checked them for proper fit, and double-locked them. I searched Grayson’s person, incident to arrest, and recovered no contraband. I allowed Grayson to call a friend to pick up his vehicle so that it would not have to be impounded.
[WITNESS #1]’s mother, [REDACTED], arrived on scene and drove [WITNESS #1] home. Grayson’s friends arrived shortly after to transport his vehicle out of the roadway. Once his vehicle was removed, I drove Grayson to the Cherokee County ADC where he and his property was turned-over to the jail staff. I completed the bookin process and an officer assessment. I issued Grayson a citation (no. 267221) for reckless driving. Once cleared by the jail staff, I returned to service.
