On 30 June 2022 at approximately 0125 hours, I stopped at the Racetrack on Marietta Highway to refuel my patrol car. I went inside the store to purchase a cup of coffee and observed two young male subjects enter the store. One of the subjects had a gray backpack slung across his back. I paid for my coffee and exited the store.
Once back in my patrol car, I saw there was only a single vehicle parked in front of the store. I ran the plate on the vehicle and it returned with a suspended registration and no valid insurance. The vehicle was parked and unoccupied. I went back to service. A short time later, I observed that same vehicle, a 2016 Dodge Charger, exit on to Marietta Highway heading eastbound. I initiated a traffic stop.
I approached the vehicle, introduced myself to the driver, later identified as Matthew Hunter Satterfield, and asked him for his driver’s license. Matthew said he did not have his driver license with him. I asked the passenger in the vehicle, later identified as Jackson Ramsey Moore, if he had any identification. Jackson provided me with his license. I told Matthew the reason for the stop was the vehicle had a suspended registration and did not show any insurance. Matthew said the vehicle belonged to his cousin and he was not aware.
I ran both subjects through dispatch and both returned with class D licenses. Deputy Henry arrived as backup. I asked both subjects to exit the vehicle. As Matthew exited the vehicle, I could smell the odor of marijuana coming from inside the vehicle. I explained to Matthew and Jackson they would need to call someone, with a valid driver’s license to come pick them up as the vehicle would be impounded.
I asked Matthew if there was any marijuana inside the car. Matthew said he did not know as it was not his vehicle. I told Matthew I could smell the odor of marijuana coming from the car and I was going to search to vehicle. I asked him to be honest with me. Matthew said he did not have any marijuana. While searching the vehicle, I found a small marijuana bud along with a small amount of shake under the passenger side front seat. I asked Matthew and Jackson who owned the marijuana and Jackson said it was his.
I also found a gray backpack in the front floorboard of the passenger side of the vehicle containing a 9mm semiautomatic handgun fully loaded with a round in the chamber. I asked Jackson if this was his gun. Jackson said it was. I told Jackson I had seen him inside the Racetrack earlier with this same backpack across his back. Jackson nodded his head. I asked Jackson how old he was, Jackson said he was 18. I told Jackson in the state of Georgia, one needed to be 21 to purchase a handgun. Jackson said the folks at Appalachian Guns in Jasper told him it was fine for him to have the gun. I looked further into the situation and confirmed the issue was not in him possessing the handgun but rather purchasing or carrying it concealed.
After consulting with Sgt. Portmann and Sgt. Shaw, there was still some uncertainty given the newly passed constitutional carry laws in Georgia so I informed Jackson that hew would only be charged with possession of marijuana lass then 1 ounce tonight. I told Jackson, I would seize the firearm as evidence and consult with the district attorney’s office in regards to the gun possession and afterwards, I would either return his gun as property or charge him for the unlawful carry. Matthew was charged with driving an unregistered vehicle, driving a vehicle without insurance and violation of class D license. Jackson was charged with possession of marijuana less than 1 ounce.
Both subjects were release on citations. The vehicle was impounded and removed by Daniels wrecker service. I have reached out to the solicitor’s office and am awaiting their direction on next steps regarding the possession of a loaded, concealed handgun by a person under 21.
