Officer’s Narrative:

On August 26, 2022, at 12:35 p.m., I responded non-emergency to a call that I received from Cherokee County Dispatch in reference to a hit-and-run accident at 2210 Holly Springs Parkway.

When I arrived at the scene, I was greeted by the complainant beside his blue Honda Civic. The complainant was identified as [VICTIM #1] and he stated that someone had hit his vehicle and left the scene of the accident. I asked him if anyone was parked beside him when he had parked in the parking stall and he told me “No”. [VICTIM #1] stated that he had went into the restaurant to eat, and when he came out, he found that his vehicle had been damaged. The vehicles that were currently parked beside his blue Honda Civic were not there before he had arrived. I looked at the vehicle parked next to his, and there were no signs of damage or paint exchange on the other vehicles.

I then went into the business of Springs Smoke Shop to locate cameras that may have captured the incident. I spoke with the front desk associate, and he stated that he can get the video footage as soon as the manager can download the video footage. I asked if I could see the camera’s angles and which direction they pointed, and he showed me. The video camera angles pointed directly at the spot where the incident had occurred. I provided the front desk associate with a case number and my work email to contact me when the video footage is available. A follow-up will be conducted for the video footage of the incident.

As I was getting ready to leave the smoke shop, [VICTIM #1] came to the front entrance of the smoke shop and stated that the vehicle that hit his vehicle was currently outside in front of his vehicle. He pointed to a grey Mazda that was parked in front of his vehicle. I approached the vehicle and spoke with the driver who was identified as Jeanne Linkul. I requested the driver of the vehicle to park the vehicle. When the vehicle came to a stop on two parking stalls, the driver came outside of the vehicle and immediately handed me an insurance card. I asked her if she was involved in the incident, and she told me “Yes”. I asked her for her driver’s license, and she went to grab her license out of her vehicle.

When she returned, I could smell the odor of an alcoholic beverage emitting from her person. When she handed me her driver’s license, I asked her if she had consumed any alcoholic beverages and she told me “No”. I then told her that I could smell the odor of an alcoholic beverage emitting from her person, and she told me that she had consumed Jack Daniels (Brand of Tennessee Whiskey). I asked Jeanne how much she had consumed, and she stated that she had drank only one glass of Jack Daniels with Diet Coke. I asked her what the size of the glass was that she consumed the alcoholic beverage and she demonstrated with her hands. She also told me that the alcoholic beverages were consumed at the restaurant in Las Palmas.

Jeanne proceeds to tell me that she takes medication for sleeping disorders (Temazepam) and thyroid disease. I asked Jeanne if she normally consumes alcoholic beverages when she takes her medication and she stated “no”. I asked her why she was consuming alcoholic beverages and if she is taking medication and her response was “I am sorry”. I asked her if she had felt her vehicle strike the other vehicle when she was departing the parking lot, and she would not give me a clear answer. She stated that she did not know. A part of Jeanne’s vehicle was laying in the parking lot in front of the blue Honda Civic when I had arrived on the scene that appeared to match the siding of Jeanne’s vehicle.

I asked Jeanne if she would consent to field sobriety evaluations to determine what her level of impairment was, and she consented. My front patrol vehicle’s blue lights were turned off during the entire duration of the field sobriety evaluations. The field sobriety evaluations were performed on level ground in front of my patrol vehicle. I requested Jeanne to stand up straight, place her hands down at her side, and keep her head straight. I asked her ifs he had any disabilities that would cause her any pain and she stated that she has an ear infection and takes medication for it. I asked her if she wore corrective lenses or contacts and she stated “no”. I asked her if she had any other disabilities other than her ear infection and she stated that she has thyroid disease. She stated that she also takes medication for her thyroid disease.

I checked Jeanne’s eyes for the following:

  • Preliminary check of eyes
  • Pupils were of equal size
  • Equal tracking present in both eyes
  • No resting nystagmus

Horizontal Gaze Nystagmus (HGN): 4 out of 6 clues

  • Lack of smooth pursuit: present in both eyes
  • Distinct and sustained nystagmus at maximum deviation: present in both eyes
  • The onset of nystagmus prior to 45 degrees: not observed
  • Vertical nystagmus: not observed

Walk-and-Turn Instructions:

  1. I told her to imagine a straight line in front of her, put her left foot in front of her right foot touch heel-to-toe, and keep her hands down at her side.
  2. Remain in this position and do not begin until I tell you to.
  3. When I tell you to begin, take 9 heel-to-toe steps on the line and count out loud, then when you reach 9 steps, keep your forward foot planted, take a small series of steps to turn around, and take 9 steps back. Once you begin, do not stop until you have completed the evaluation. Do you understand the instructions? (She told me that she understood even though I had to repeat the instructions multiple times).

Observations of Walk-and-Turn Evaluation: 5 out of 8 clues

  • Starts too soon
  • Misses heel-to-toe
  • Uses arms for balance
  • Improper turn
  • Incorrect number of steps

I then went on to the One Leg stand Evaluation and gave her the following instructions:

  1. Stand with your feet together and arms down at your side, lift your foot 6 inches parallel off the ground, look at your foot, and count out loud until I tell you to stop.
  2. Do not begin until I tell you what to, do you understand?

Observations of One-Leg-Stand (timed for 30 seconds): 3 out of 4 clues

  • Uses arms for balance
  • Puts foot down
  • Sways

I then told her that the evaluation was complete. After telling her to stop with the evaluation, I went to my patrol vehicle and retrieved my Alco-Sensor. I asked her if she would consent to provide a breath sample from the Alco-Sensor and she consented. The Alco-Sensor indicated a positive reading for alcohol.

Based on the field sobriety evaluations, Jeanne was not fit to operate a vehicle on the roadway. I then told her that she was being placed under arrest for driving under the influence of alcohol. I placed the handcuffs on her wrists from the front, checked for proper fit, and double-locked the handcuffs. The handcuffs were placed on her wrists from the front in consideration of her disabilities. I visually searched her waistband with no physical contact and could not see any weapons or contraband. She was seated in the right rear seat of my patrol vehicle with the rear windows down, and she placed her seat belt on.

While she was in the back seat of my patrol vehicle, Jeanne stated that she parked on the other side of the parking lot after the incident had occurred with the other vehicle. Jeanne did not appear on the scene until my arrival. I read Jeanne the (green card) implied consent for persons over the age of 21, and she consented to a blood draw.

I safely transported Jeanne to Fire Station 8 to have a blood draw conducted by trained Fire/ EMS. After Fire Station 8, I safely transported Jeanne to Cherokee County Detention Center, and she was turned over to the Cherokee County Detention Center Deputies with no incident. Jeanne’s blood sample that was provided at Fire Station 8 was placed in to evidence locker 7. Property Receipt # 01248. [REDACTED] was the AEMT at Fire Station 8 that withdrawed the blood. Jeanne’s vehicle was left on private property properly secured in front of the business of Saporitos.

Jeanne was charged with the following:

  • DUI (O.C.G.A. 40-6-391)
  • DUI less safe (O.C.G.A. 40-6-391A1)
  • Hit and Run (O.C.G.A. 40-6-270)

Waiting for Springs Smoke Shop to provide video surveillance of the incident. Vehicle mileage was called out before and after every transportation.
