On Friday, August 15, 2025, at 6:18 p.m., I was dispatched to [300 BLOCK] Faulkner Court for a road rage incident. The caller, [VICTIM #1], told dispatch a truck drove beside him and pointed a gun at him. [VICTIM #1] said it was a teal Chevrolet Silverado, and the truck turned around and went back the way it came. [VICTIM #1] said he wanted to meet with a deputy at [300 BLOCK] Faulker Court. [VICTIM #1] said the incident occurred near Lower Bethany Road and Ball Ground Highway. [VICTIM #1] said the person driving the truck was a bald Hispanic male, possibly in his 40s. [VICTIM #1] had a passenger in the car with him.
I arrived at [300 BLOCK] Faulkner Court, where I met with [VICTIM #1] and the passenger, [VICTIM #2]. [VICTIM #1] and [VICTIM #2] approached my patrol car when I arrived. Both males appeared scared and visibly shaken.
[VICTIM #1] began explaining what happened. [VICTIM #1] was driving a white 2017 Nissan Sentra [REDACTED]. [VICTIM #1] said he was turning right onto Lower Bethany Road from Heard Road. [VICTIM #1] was stopped at the stop sign. [VICTIM #1] said there was a male across the street messing with a trailer. [VICTIM #1] said he yelled something at the male. I asked [VICTIM #1] what he yelled, and he said, “Nice trailer.”
[VICTIM #1] then drove down Lower Bethany Road towards Ball Ground Highway. [VICTIM #1] was stopped at the stop sign to turn left onto Ball Ground Highway from Lower Bethany Road. While stopped at the stop sign, a dark teal, newer model, Chevrolet Silverado, pulled up next to them. While next to them, the driver of the truck pulled a handgun and pointed it at both the driver and the passenger of the car. [VICTIM #1] said once the male pointed a gun at them, he “took off.” [VICTIM #1] drove away and pulled into the driveway of [300 BLOCK] Faulkner Court.
I asked [VICTIM #1] and [VICTIM #2] what the gun looked like. [VICTIM #1] said he didn’t know what it looked like. [VICTIM #1] said, “I was looking down the barrel of the gun. [VICTIM #2] said it was a smaller frame handgun, with a black frame and a grey slide.
[VICTIM #1] and [VICTIM #2] both said they wanted to press charges against the driver of the truck. Neither [VICTIM #1] nor [VICTIM #2] got a tag number for the car. I asked [VICTIM #1] if he could look up a picture of what the car looked like. [VICTIM #1] looked up a picture on Google of a new Chevrolet Silverado 2500, which was a dark teal color, almost grey. I provided [VICTIM #1] with a case number.
After speaking with [VICTIM #1], I drove down Lower Bethany Road and Heard Road, looking in the area where [VICTIM #1] said the truck originally was. While looking for the car, I saw a grey, newer model Chevrolet Silverado parked behind the residence of [1400 BLOCK] Lower Bethany Road.
I received a phone call request through dispatch from [VICTIM #1]. [VICTIM #1] said the truck was possibly in front of me after I drove away from speaking with them. I informed [VICTIM #1] it was a different model truck. I then asked [VICTIM #1] where exactly he saw the car. I asked [VICTIM #1] if it was across the street from Heard Road at Lower Bethany, and he said yes.
I asked [VICTIM #1] if there was a trailer in the front yard, and he said yes. Corporal Seibel and I went to [1400 BLOCK] Lower Beathany Road. I approached the door, and a middle-aged, bald, Hispanic male answered. I spoke to the male, Jorge Hernandez. I asked Jorge if he would speak with me about an incident which had happened earlier, and Jorge said if it was about kids.
Jorge said the kids were in a white sedan. Jorge and I walked behind his house to his truck. The truck matched the description [VICTIM #1] and [VICTIM #2] gave me. Jorge said the kids were on Heard Road at the stop sign, about to turn right onto Lower Bethany Road. While stopped at the stop sign, one of the kids in the vehicle yelled, “That fu*king trailer sucks.” Jorge said he got into his truck and caught up to the white sedan on Lower Bethany Road at Ball Ground Highway. Jorge said he pulled up next to the vehicle and put his hands up.
The vehicle turned left onto Ball Ground Highway, and Jorge turned around and went back home. I asked Jorge if he owns any firearms, and he said he had a handgun. Jorge said it was a 380 with a black frame and a grey slide. Jorge said he never pulled a gun on the white sedan. Jorge showed me his handgun. Jorge had a Ruger LCP MAX (SN: 380951783). The handgun had a magazine in it, loaded with ten nine rounds of 380 auto. Jorge said he always kept the gun in his pocket.
Jorge said he had his gun in his pocket when he confronted the kids in the white sedan. Jorge said he never pulled the gun out of his pocket. Jorge said he had no reason to pull out his gun. Jorge then said he did pull the gun out of his pocket, but never pointed it at the vehicle. Jorge said he held the gun up, with it pointed in the air.
I told Jorge he was under arrest and to put his hands behind his back. I put Jorge in handcuffs, checking for proper fit, and double-locking them. I searched Jorge, then put him in the rear seat of my patrol car and secured the seat belt. I transported Jorge to the Cherokee County Adult Detention Center, where he was turned over to jail staff. Once jail staff removed Jorge from my patrol car, I searched the rear seat for contraband, finding none.
I secured a warrant for Jorge, charging him with two counts of aggravated assault and two counts of simple assault. The gun, magazine, and ammo were sealed and placed into Waleska evidence locker #1.
