[NARRATIVE #1 on July 22, 2022]

On July 22, 2022, I was contacted by agents from the Cherokee Multi Agency Narcotics Squad about a vehicle with cancelled registration and no insurance. The vehicle, a silver 2015 Lexus GS (GA tag #[REDACTED]), was in the area of Wade Green Road and Highway 92. I ran the tag through GCIC and I too noticed the vehicle had a cancelled registration with no valid insurance. I turned off of Wade Green Road onto Highway 92 and noticed the vehicle with that tag attempting to make a left turn from Highway 92 into the Shell Gas Station. I made a U-turn and got behind the vehicle. As the vehicle turned across Wade Green Road, I initiated a traffic stop.

Once in the Shell Gas Station parking lot, I spoke with the driver, Emmanuel Blackwell. Emmanuel immediately exited the vehicle which I found odd. I told Emmanuel the reason for the stop and he seemed shocked. He told me his insurance was on autopay and should still be valid. I asked him to step to the front of my patrol car and followed up with a few questions. I asked him if he was on probation and he told me he was. He then told me there was an open bottle of liquor in the glove box, however, he had not consumed alcohol today. He then told me I was allowed to search the vehicle without me asking. I told him we would worry about that at a later time but I wanted to confirm whether or not his vehicle was insured. Emmanuel then contacted Geico in attempt to speak with an agent.

While I have was having this conversation, Deputy Steer walked into the Shell. While I was still conversing with Emmanuel, Deputy Steer exited the Shell with a female in handcuffs. Emmanuel was shocked and asked why she was being arrested. I told him I was unsure and he told me that was his girlfriend. I asked him to stay focused and he spoke with a Geico agent. He provided his information to the agent and she confirmed the policy was cancelled due to non-payment. I told Emmanuel I would be impounding his vehicle and completing a citation. Emmanuel told me understood.

I completed a citation charging Emmanuel with driving with no valid insurance (Citation # 280652). I also completed the impound form (62816). During the inventory of the vehicle, I located prescription medications all belonging to Emmanuel. An open bottle of vodka was located inside the locked glovebox. No illegal items were located in the vehicle. Ingrams towing arrived on scene and I released the vehicle to them. I stood by with Emmanuel while CMANS continued their investigation. Emmanuel was detained per their request and placed into handcuffs. After several minutes of waiting, I was told Emmanuel was no longer being detained and could be released from the scene.

I explained the citation to Emmanuel and confirmed his mailing address. Emmanuel told me he understood the citation and his court date, then signed the citation. He was given his copy of the citation and released from the scene. I then returned to service.

[NARRATIVE #2 on July 22, 2022]

On July 22, 2022 I responded as backup for Sgt. Lupo who was on a traffic stop at Highway 92 and Wade Green.

I came to the traffic light and was waiting to turn into where Sgt. Lupo was located. I received a call from Cpl. Dennis who is a supervisor with CMANS. Cpl. Dennis advised to go inside the Shell gas station and locate a white female wearing black shirt and black pants. Cpl. Dennis told me to detain the female and escort her out of the store and take her to my patrol car. I went inside the store and located the female. I asked the female to place her hands behind her back, explaining she was not under arrest but being detained for the time being. I had the female walk out of the store to my patrol car.

K-9 Deputy Stark arrived on scene a short time later and I turned the investigation over to him. While standing with Deputy Stark he asked the female, Kayley Pugliese, if she would consent to a search of the purse she had on her. Kayley advised he could which I noticed he removed a couple prescription medication bottles from her bag along with a pill holder. The medication bottles and pill holder were placed in the front seat of my patrol car at this time for safe keeping. I remained with Kayley at my patrol car while Deputy Stark completed his investigation.

Once Deputy Stark finished his investigation, Kayley was placed under arrest. Kayley asked if we could turn her vehicle she was driving over to someone so it would not be towed. Kayley asked if we could turn the vehicle over to her friend [REDACTED], who was at the gas station. I went to speak with [REDACTED] and asked if she would take the vehicle. [REDACTED] advised she would take the vehicle and I told [REDACTED] she could take the vehicle and was free to leave with it. The pill holder and medication bottles were turned over to Cpl. Dennis.

[NARRATIVE #3 on July 22, 2022]

On July 22, 2022, I went to the Shell gas station located at 6045 Highway 92 in regards to a traffic stop Sergeant Lupo had conducted on a silver Lexus belonging to Emmanuel Blackwell. Deputy Steer had also detained Kayley Pugliese who was the female that was involved in the possible hand to hand drug transaction observed by CMANS agents. Prior to me arriving on scene, I had conducted a traffic stop on the Hyundai Tuscon driven by Michael Johnson, who was the other party involved in the drug transaction. During the stop I located a small corner cut baggy of cocaine. (SO22-0010138). Upon my arrival, I went and spoke with Kayley.

I explained to Kayley why I was at the location and asked for per consent to search her vehicle, which was a white Chevrolet Tahoe displaying Georgia tag [REDACTED] parked at on the gas pumps. Kayley gave me consent to search her vehicle. Before going to search the vehicle, I asked Kayley for consent to search her purse, which she granted. Inside her purse, I located a plastic pill holder containing numerous pills. I also located prescription bottles belonging to Kayley as well as another person. Upon looking inside the bottles, I observed one of them to have two different types of pills inside. The bottle was supposed to contain Oxycodone, but there was also Hydrocodone tablets inside the bottle. I asked Kayley about this. Kayley said she had gotten them from a friend. I asked if she had a prescription for the Hydrocodone and she stated no.

I went to search her vehicle. During the search of the vehicle nothing illegal was located. At this point and went to ask Emmanuel for consent to search his vehicle, which he granted. The reason for asking him for consent was CMANS agents had observed him interacting with Kayley at the gas statin during the time the hand to hand drug transaction between Kayley and Michael Johnson was conducted. Kayley had also stated Emmanuel was her ex-boyfriend. During the search nothing illegal was located. At this point Agent Dennis was on scene and we conducted and interview with Kayley.

Once the interview was complete, Kayley was placed under arrest for possession of a schedule II controlled substance, Hydrocodone and transported the Cherokee County Adult detention Center by Deputy Oler. I went and asked Emmanuel if he would be wiling to speak with us and he stated no. Once the investigation was concluded, Emmanuel was taken out of handcuffs and released on a citation for not having valid insurance on his vehicle. All evidence was turned over to Deputy Steer who transported it to the Oak Grove precinct to be processed by CMANS agents. I returned to service.
