Officer’s Narrative:

On 1/6/2026 at approximately 2153 hours I was dispatched to a call for service for a suspicious person at 149 Prominence Point Pkwy (Teddy’s BP Gas Station).

Upon my arrival I spoke with [WITNESS #1] who informed me that she was at one of the pumps when she observed a white male, brown hair, blue jeans, driving a black truck approach another driver in a blue truck and begin to yell “give me my fu*king money” while banging on the door of the blue truck. Ms. [WITNESS #1] stated that the male continued to yell and cuss in the parking lot of the gas station while walking around in circles before leaving and parking in the dollar tree parking lot.

I observed a black truck parked in the dollar tree parking lot across the street and confirmed with Ms. [WITNESS #1] that it was the same black truck as before. Upon approaching the black truck, which I observed was running, I made contact with a male matching the description given by the witness in the driver’s seat of the black truck.

Upon making contact with the male, later identified as Nathan Harvey Bushee, I could smell the strong odor of an alcoholic beverage coming from Nathan as well as observe glossy eyes, and slurred speech. Nathan was continually resistant to my commands to step out of the vehicle, at one point attempting to put the vehicle in drive. Nathan then handed me the keys and then tried to start the car back up as if he still held the keys.

Upon opening the driver’s side door I observed an empty alcoholic beverage container on the driver’s floorboard. Upon Nathan exiting the vehicle I could still smell the strong odor of an alcoholic beverage coming from Nathan. Nathan gave me consent to pat him down and then I allowed him to smoke a cigarette while I continued to interview him.

In a past contact I had with Nathan, allowing him to smoke a cigarette and the presence of multiple officers deescalated Nathan and allowed officers to place Nathan under arrest with no resistance, thus I allowed Nathan to smoke and refrained from detaining him in handcuffs until another unit arrived.

I then continued to question Nathan in regards to the situation at the BP gas station to which Nathan would only insist that I either let him go home or take him to jail. Nathan told me that the people at the BP gas station were “bullsh*tting” to which I asked him how they were lying.

At this point Nathan attempted to walk off and I attempted to restrain Nathan to prevent his evasion of lawful arrest at which point he became physically resistant by pulling away and attempting to shove me off of him. I assisted Nathan to the ground and Nathan complied with my orders, allowing me to place him in handcuffs.

At this point I searched Nathan incident to arrest yielding nothing of evidentiary value. I then ensured that his handcuffs were double-locked and checked for fit and then I placed Nathan in the back of my patrol vehicle with the assistance of Officer Wilson.

I spoke with Nathan’s girlfriend, [REDACTED], who had shown up on scene, to inform her of the situation. [REDACTED] told me that she had Nathan’s location and confirmed that he had been in the area for a while. When I told [REDACTED] that Nathan was visibly intoxicated she stated “I know.”

I then requested Sgt. Mueller and Officer Wilson to search the vehicle for fruits of the crime and inventory the vehicle as it would be impounded. I then transported Nathan to the Cherokee ADC. While at the ADC Nathan was disorderly with the deputies after being dressed out and was put into a holding cell immediately. I also obtained a search warrant for Nathan’s blood and informed him that he is commanded to provide a sample of his blood to which he refused. Due to this another warrant will be taken for Obstruction due to him not complying with a lawful search warrant signed by a judge.

After leaving the ADC I returned to the BP Gas Station where staff allowed me to utilize their camera footage. I found multiple camera angles depicting a male matching Nathan’s description exactly drive his truck into the gas station, park the truck and enter the convenience store.

Shortly after the footage shows the man believed to be Nathan exit the gas station and begin arguing with the driver in a black SUV. The man believed to be Nathan became visibly upset and appeared to be yelling. The male matching Nathan’s description then attempted to walk around to the driver’s side of the black SUV to which the driver responded by quickly backing up the vehicle and leaving the gas station. The male believed to be Nathan then walked over to a blue truck and yelled at the driver and hit the hood of the blue truck.

Due to the totality of the circumstance, including the strong odor of an alcoholic beverage, glossy eyes, slurred speech, impaired motor functioning, as well as Nathan Harvey Bushee being in the driver’s seat and the witness testimony that he drove the vehicle across the street to the Dollar Tree parking lot I believe Nathan Harvey to have been under the influence of alcohol while in physical operation of a motor vehicle.

His condition and actions including yelling at other motorists and hitting the hood of the blue truck were disorderly conduct and actions pursuant to public drunkenness. Lastly, Nathan’s attempt to evade arrest by walking away from his detention and becoming physically resistant when I attempted to place him in handcuffs are pursuant to obstruction of a police officer without threat or use of violence.
