[NARRATIVE #1]
On May 3, 2022, dispatch gave out a bolo for a white Jeep Grand Cherokee or Jeep Liberty leaving the address [200 BLOCK] Evans Cook Road. According to the caller, the male driving the Jeep was going to the Race-Trac gas station on Marietta Highway in Canton. The caller also stated the male driving did not have a driver’s license and had drugs in his pocket.
I responded to the area and got behind a white Jeep Liberty turning onto Cumming Highway from Scott Road. I suspected this was the vehicle given the area it was coming from. I ran the Georgia tag being displayed on the rear of the Jeep, [REDACTED]. The returns indicated the vehicle belonged to a [REDACTED] from Jasper, GA. I looked up the caller’s name and it was listed as anonymous and the caller also failed to leave a suspect name.
Based on the lack of information provided by the caller, I did not stop the vehicle. I followed the vehicle onto I-575 south from Cumming Highway, and once we were on the interstate, I passed the vehicle. As I passed, I looked at the driver and noticed he appeared to be an older male with a beard. I exited the interstate onto Georgia Highway 140. I stopped on the side of the roadway and looked at the call history for [200 BLOCK] Evans Cook Road. There were 28 previous calls at that address. On several of the calls, there was a male with the same last name of the registered owner of the Jeep I ran leaving the area.
One call was a residence check called in by APS. The call record for this is SO022022755. APS was wanting the Sheriff’s Office to respond to the address to make contact with a John Waller. In the call notes, I noticed a note where John was reported to have a warrant for his arrest through Cherokee County for Failure to Appear on a traffic stop. I ran John through GCIC and his returns indicated he was wanted. They also indicated John’s driver’s license was suspended. I looked at the driver’s license photo of John and he matched the description of the driver of the Jeep. It was at this point I believed a wanted male with a suspended driver’s license was operating the Jeep I saw. I based this on the totality of the information provided to me by the dispatcher and from my own investigation.
I returned to the area of Scott Road and Cumming Highway in order to wait to see if the Jeep returns. I waited with Sgt. Jones and Deputy Y. Lee. While there, I noticed the Jeep approaching our location on Cumming Highway from I-575. I watched as it passed in front of us. I noticed the vehicle cross over the center yellow line and also heard it hit the lane markers. I looked at the tag on the Jeep, and noticed the tag matched the same one I ran earlier. Deputy Lee got behind the vehicle and conducted a traffic stop on Scott Road.
I arrived at the traffic stop location and walked up to the Jeep on the driver side. I met with the same male I saw driving earlier and whom I believed to be John Waller based on the driver’s license photo. I asked the male for his driver’s license and he told me he did not have it with him. I asked him to provided me with his name. He stated he was Jeffery Scott Justus. I would later determine this was not John Waller driving but instead Jeffery Justus. Jeffery is the father of the registered owner of the Jeep.
Believing I was just given a false name, and the crimes of failure to maintain lane, and driving without a license, I asked Jeffery to exit the car. Once out of the car, I placed his wrists in handcuffs. I used two set of handcuffs due to Jeffery complaining of a recent surgery on one of his wrists. While handcuffing Jeffery, he told us, “She put all of the dope in her mouth.” Jeffery was referring to the passenger Tracey Allen. I also heard Tracey tell Jeffery that she was the one to call 911 on him.
I went to my patrol car to run Jeffery’s information through GCIC and the returns showed that his license had been expired since 2011. I returned to explain to Jeffery why he was stopped and he agreed that he failed to maintain his lane when he passed us at Scott Road. I explained to Jeffery that he looked like a wanted person that was at his house a few days prior, John Waller. Jeffery told me he was not John and he explained that John was currently at his house on Evans Cook Road. Jeffery was complaining of his wrists hurting so I allowed him to twist one around to keep it from hurting. I checked the handcuffs again for proper fit and double locked the.
Sgt. Jones asked Jeffery who owned the Jeep and he told us he did. He then explained his son was about to have it. Sgt. Jones asked Jeffery for consent to search the Jeep and he granted it. During the search of the Jeep, I located a baggie with methamphetamine in the center console. This area of the vehicle is easily accessible to both Jeffery and Tracey. In the back of the Jeep, I located a black bag. Inside of this bag was a glass container that also contained a baggie of methamphetamine. Based on the location of the bag, it would have been impossible for either person to get into this area of the Jeep to hide the meth during the traffic stop. Instead, it is most likely this was placed here prior to the vehicle ever being in motion.
Deputy Lee advised Jeffery and Tracey of their Miranda Rights and they agreed to talk. I spoke with Jeffery and he claimed Tracey must have planed the methamphetamine in the car. He added that Tracey is always trying to get him into trouble. I asked Jeffery about the methamphetamine I located in the rear of the vehicle. Jeffery claimed to have no knowledge of it. I asked him who else had access to the Jeep and he said his son did. I asked Jeffery about his knowledge of his son’s drug history and he told me he does marijuana. He added that he has never known of his son using methamphetamine.
I asked Jeffery about his drug usage and he admitted that he has used methamphetamine in the past. We asked Jeffery how him and Tracey ended up in the same vehicle. Jeffery said Tracey called him to come pick her up. He showed us in his cell phone where he got a call from her at 0124 hours. I checked with the dispatcher about what time we received the 911 call and that call was received at 0130 hours. Tracey told us she was the person that placed the 911 call in order to get Jeffery into trouble.
During my conversation with Jeffery he denied having any knowledge of the narcotics located in his Jeep. He also continued stating that Tracey must have planted the drugs to get him into trouble. I did not find Jeffery to be credible. When he first got out of the Jeep on my request, he almost immediately stated that Tracey ate the dope. This told me that he actually had knowledge of narcotics in the Jeep; otherwise, he would not have known about it until he was confronted by Law Enforcement post search. Furthermore, he was owner/operator of the Jeep and I located methamphetamine in a location not accessible to Tracey.
Prior to Jeffery being transported to the jail, he asked me to listen to some voicemails on his phone that were left by Tracey. Jeffery told me the passcodes to get into the phone and instructed me on how to get listen to the calls. During several calls, I heard Tracey telling Jeffery to pick her up and bring her some stuff because she needed it. I asked Jeffery what she was referring to and she said she was wanting him to bring her some pills. I did not hear any voicemails where Tracey threatened to plant narcotics on him to get him into trouble.
Jeffery was transported to the jail by Deputy Lockstedt. The two baggies of methamphetamine were given to Deputy Lee. I took photos of the narcotics and they will be uploaded to the case file. The vehicle was impounded by Daniels. This was recorded on Impounded Vehicle Inventory 56289. I returned to service.

[NARRATIVE #2]
On May 3, 2022, at approximately 0130 hours, Dispatch notified us a male driving in his White Jeep Cherokee or Compass just left [200 BLOCK] Evans Cook Road and headed to a RaceTrac located on Marietta Highway with no driver’s license and had illegal drugs in his vehicle. I responded to the call from Free Home Precinct and realizing I was too far away from the incident’s location, I decided to circle around Cumming Highway, Highway 140 and Scott Road in my patrol vehicle to attempt to locate the suspected vehicle, but I was unable to locate one.
I then parked my patrol vehicle near Cumming Highway and Scott Road and observed oncoming traffic for the suspected vehicle to return to [200 BLOCK] Evans Cook Road. Shortly after, a white Jeep Compass which matched the description of the suspected vehicle from Dispatch’s BOLO, passed in front of me and it crossed a double yellow line and ran over the rumble strip which made a vibration noise that gave me reasonable suspicion to stop the vehicle.
I followed the vehicle, a 2021 white Jeep Compass (GA Tag: [REDACTED]) and initiated my emergency lights and conducted a traffic stop near Scott Road at Epperson Road. The vehicle was occupied by two occupants, the driver later identified as Jefferey Justus, and the passenger, Tracey Allen. I noticed the vehicle’s tag was the same tag from earlier that Sergeant Patterson ran through Dispatch. I conducted a passenger-side approach and asked both parties for their driver’s licenses. Both parties stated they did not have a driver’s license on them. Shortly after, Sergeant Jones and Sergeant Patterson arrived on scene.
Sergeant Patterson conducted a driver-side approach and requested both parties to step out of the vehicle. I escorted both parties to the front of my patrol vehicle and Sergeant Jones and Sergeant Patterson conducted a vehicle search after Jefferey gave us verbal consent to search. Later, Sergeant Jones and Sergeant Patterson located a small bag of white substances that appeared to be Methaphanmaine in the center console of the vehicle and a small glass jar containing small bags of white substances that appeared to be Methaphanmaine in the back of the trunk.
I read both parties a Miranda Warning and both parties agreed to talk to us by stating yes. I first asked Jeffery if this small bag of Methaphanmaine that was found in the center console was his and Jeffery stated no, it was Tracey’s. I then asked Tracey the same question and Tracey stated no, it belonged to Jefferey. Throughout the investigation, Tracey stated she was the one who called 911 on Jefferey and accused Jefferey of possession of illegal drugs on him.
Jeffery was placed under arrest for violating OCGA 40-6-48, Failure to Maintain Lane; OCGA 40- 5-20 driving without a valid driver’s license, and due to a small clear bag of Methaphanmaine was found in the center console and Jeffery had accessibility to the center console, Jefferey violated OCGA 16-13-30 VGCSA-Possession of Methaphanmaine Schedule II Drug. Due to Tracey being the passenger of the same vehicle and Tracey also had accessibility to the center console in the vehicle. I handcuffed Tracey behind her back, checked for proper fit, and double-locked them. I placed Tracey under arrest for violating OCGA 16-13-30 VGCSA-Possession of Methaphanmaine.
I secured Tracey to the backseat of my patrol vehicle and transported her to the Cherokee County Adult Detention Center. Upon arrival at the jail, Tracey was released to the jail staff without incident. Jefferey was later transported by Deputy Lockstedt and issued citations for failure to maintain lane (Citation # 267356) and driving with no valid driver’s license (Citation #267357)and I completed all necessary booking papers for both parties and returned service after finding no contraband in the backseat of my patrol vehicle.
A small bag of Methaphanmaine from the center console and a small glass jar containing small bags of Methaphanmaine were submitted to the evidence locker and GBI submission forms were also complete. Jefferey’s cell phone was also submitted to the evidence locker. (ECR-22- 00937). On the next business day, an arrest warrant (CE0130873) for Jefferey, under case #SO22- 006059A, and an arrest warrant (CE0130872) for Tracey, under the case # SO22-006059B was secured and signed by Judge Sullenger.
