Officer’s Narrative:

I was on routine patrol at approximately 0100 hours on 08/28/2022 when Sgt. Davis advised someone did not pay his taxi fare and made threats to shot officers. Upon my arrival in the area, Sgt. Davis told arriving officers the last known location of the suspect was and after a very short search Officer Shaw and I located the suspect. The suspect was identified Xavier Jernigan (Xavier) and I immediately recognized Xavier from a previous incident earlier in the night.
Earlier, at Truck and Tap Xavier made customers and staff uneasy when he started to act confrontational toward staff. Xavier was told by staff to leave multiple times and eventually Ofc. Brown and I escorted Xavier outside. While outside, Xavier kept walking into traffic and acting weird toward pedestrians (acting like he was filming people). I then approached Xavier outside, I tried to reason with Xavier and get him a taxi (he agreed). After a short wait, Woodstock Taxi arrived and picked up Xavier and drove south on Main Street toward Mad Life Studios. After remembering Xavier from earlier, I placed Xavier in properly fitted and double locked handcuffs behind his back.
I then escorted Xavier to a nearby parking lot and met with [WITNESS #1] ([WITNESS #1]-Woodstock Taxi driver). [WITNESS #1] stated, Xavier yelled at Sgt. Davis (in his patrol vehicle) as he drove by and called him an a*shole. Xavier, then asked [WITNESS #1] to pull over so he could get his backpack and told [WITNESS #1] he would be back in a couple minutes. However, Xavier got his backpack, refused to pay, walked away from [WITNESS #1] and said he was going to his bag to shoot Woodstock Police officers in the head. [WITNESS #1] then waived down Sgt. Davis and explained to Sgt. Davis what [WITNESS #1] said.
While Ofc. Shaw was conducting a search incident to arrest on Xavier’s bag, he found a baggie with 18 pills of suspected Methylphenidate Hydrochloride (submitted into evidence for GBI testing). The baggie was unmarked, and Xavier wasn’t able to provide proof of any prescription from a medical provider.
After speaking to [WITNESS #1], I arrested Xavier for the following:
- Theft by Taking (Misdemeanor)
- Terrorist Threats
- Public drunkenness
- Possession of Schedule 2 (x2)
Xavier was then transported to the Cherokee County Adult Detention Center (ADC) and turned over to ADC staff without any incident.
