Officer’s Narrative:

On January 15th, 2026 at approximately 1:00pm, I was dispatched to a fight in progress call at the Longhorns on Riverstone Pkwy. Cherokee Dispatch advised that the caller stated that it was two black males were arguing in the parking lot. I advised that I was en-route. While en-route Cherokee Dispatch advised that the black males were getting into a silver Lexus.

Upon arrival I observed a black female talking on a cell phone in the parking lot of Longhorns. I stopped and asked if she called. She advised that they did not. There was an older black female in the passenger seat of the vehicle. I approached her and asked if she was the mother to the other female. She advised that she was. I asked what was going on. She stated that her sons had got into a verbal altercation. At this point Officer Cordry was in the area and arrived on scene. I asked Officer Pacer if he could talk with the younger female. He advised that he would.

Officer Cordry asked a male that was sitting in the back of the vehicle to step out. I observed a black male wearing all black clothes step out of the back of the vehicle. He was holding what looked like a white paper towel to his lip. I asked if that was her son. She advised that it was. I asked if she could provide her name. She stated that it was [WITNESS #1]. I asked for his name, she advised that it was Zachary Gaines. I asked what happened to him. She advised that he stated that he fell. I advised that I was going to investigate further. I asked if I watched the surveillance footage if I would see him fall. She advised at this point that her other son, [REDACTED], hit her son Zachary.

I asked if anyone had any weapons. She advised that there was two firearms in the vehicle that belonged to her and her daughter. I asked where they were located. She advised that one was in the glove box and the other was in the door. I asked if I could take them to my patrol vehicle while I was out with them. She advised that I could. The firearms were later ran through GCIC and not reported stolen. They were later returned to the owners and placed in the trunk of the vehicle.

I approached Zachary and he was difficult to talk to. I asked him what happened. He advised that he trip and fell into the toilet. Sgt. Salas arrived on scene and I asked if he could speak to the staff inside. He advised that he would. I asked Zachary why his mother told me that his brother hit him. Zachary stated that he messed up and spoke to a girl and turned her down. He advised that he received a text from someone claiming to be from the cartel. He advised that the person stated that they would “dismember” him. I asked him if this made his brother hit him. He was speaking erratically and not answering the question.

Sgt. Salas then arrived and stated that he spoke to the staff in Longhorns and they stated that Zachary and his brother were in the bathroom and they could hear yelling and loud bangs. I ran Zachary’s name through dispatch. Dispatch advised that he had warrants out of Clayton County. At this point Officer Pacer and Sgt. Salas placed Zachary in handcuffs. I asked Sgt. Salas if he would sit with Zachary while I went to check the bathroom for damage. He advised that he would.

I spoke to [WITNESS #2], who is a server at Longhorns, and she advised that there was loud bangs coming from the bathroom. I asked if she could hear any yelling. She advised that she did. She advised that she heard a male state “get your mother fu*king a*s out of the bathroom.” Other staff advised that they heard the yelling and banging as well. They also advised that the yelling disturbed many of the guest.

Cherokee Dispatch did advised that there was multiple callers while I was en-route. I radioed to Sgt. Salas that we would have charges of Disorderly as well. I then returned to my patrol vehicle. Sgt. Salas and Officer Pacer did place Zachary in the back of my vehicle while he was detained. I then advised to Cherokee Dispatch that I was en-route to Cherokee ADC.

I arrived to Cherokee ADC without any incident. I wrote Mr. Gaines a citation for 32-4 Disorderly Conduct and released him to the custody of the Cherokee County Sheriffs Department. Mr. Gaines was informed of his court date and signed the citation stating he understands he has court on 03/18/2026.

I then returned to service for calls.
